Stat. tit. 63, § 63-1-1961","heading":"Definitions","body":"As used in the Home Care Act:\n\n1. “Board” means the State Board of Health;\n\n2. “Certification” means verification of appropriate training\n\nand competence established by the State Commissioner of Health by\n\nrules promulgated pursuant to the Home Care Act for home health\n\naides and home care agency administrators;\n\n3. “Department” means the State Department of Health;\n\n4. “Health care provider” means a physician, physician\n\nassistant or Advanced Practice Registered Nurse recognized by the\n\nOklahoma Board of Nursing as a Certified Nurse Practitioner or a\n\nClinical Nurse Specialist;\n\n5. “Home care agency” means any sole proprietorship,\n\npartnership, association, corporation or other organization which\n\nadministers, offers or provides home care services, for a fee or\n\npursuant to a contract for such services, to clients in their place\n\nof residence. The term home care agency shall not include:\n\na. individuals who contract with the Department of Human\n\nServices to provide personal care services, provided\n\nsuch individuals shall not be exempt from\n\ncertification as home health aides,\n\nb. organizations that contract with the Oklahoma Health\n\nCare Authority as intermediary services organizations\n\n(ISOs) to provide federal Internal Revenue Service\n\nfiscal and supportive services to Oklahoma Consumer-\n\nDirected Personal Assistance Services and Supports\n\n(CD-PASS) waiver program participants who have\n\nemployer responsibility for hiring, training,\n\ndirecting and managing an individual personal care\n\nattendant,\n\nc. CD-PASS waiver program employer participants, or\n\nd. PACE organizations as defined by 42 C.F.R., Section\n\n460.6;\n\n6. “Home care services” means skilled or personal care services\n\nprovided to clients in their place of residence for a fee;\n\n7. “Home health aide” means an individual who provides personal\n\ncare to clients in their temporary or permanent place of residence\n\nfor a fee;\n\n8. “Home care agency administrator” means a person who\n\noperates, manages, supervises, or is in charge of a home care\n\nagency;\n\n9. “Personal care” means assistance with dressing, bathing,\n\nambulation, exercise or other personal needs;\n\n10. “Skilled care” means home care services performed on a\n\nregular basis by:\n\na. a trained respiratory therapist/technician,\n\nb. a person currently licensed by this state including\n\nbut not limited to a Licensed Practical Nurse,\n\nRegistered Nurse, physical therapist, occupational\n\ntherapist, speech therapist, or social worker, or\n\nc. for the exclusive purpose of the program established\n\nunder Section 1 of this act and subject to the scope\n\nof practice standards and restrictions established by\n\nthe Authority under Section 1 of this act, a family\n\nmember of a Medicaid enrollee who is recognized by the\n\nAuthority as a family caregiver;\n\n11. “Standby assistance” means supervision of client directed\n\nactivities with verbal prompting and infrequent, incidental hands-on\n\nintervention only; and\n\n12. “Supportive home assistant” means an individual employed by\n\na home care agency who provides standby assistance to ambulatory\n\nclients, in conjunction with other companionship or homemaker\n\nservices, in the temporary or permanent place of residence of the\n\nclient for a fee.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"67c4e8382675a4bc08d9e275ea36d1f1b8a284500e8e769b550ed11bdb242036","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-1-1960","next":"us-ok/okla.-stat.-tit.-63-63-1-1962"},"notice":"GroundRules: Original legal text.
