The State Board of Health shall have authority to\n\ndetermine the qualifications, skill and fitness of any person\n\nemployed to serve as an administrator of a home care agency. The\n\nState Board of Health in promulgating rules pursuant to this section\n\nmay consider advice and comments from representatives of home care\n\nagencies, home care agency administrators and representatives of\n\nstatewide organizations for home care agency clients.\n\n2. The State Board of Health shall develop standards which must\n\nbe met by individuals in order to receive certification as a home\n\nhealth agency administrator, which standards shall be designed to\n\nensure that home health agency administrators will be individuals\n\nwho are of good character and are suitable, and who, by training or\n\nexperience, are qualified to serve as home health agency\n\nadministrators.\n\nB. The State Department of Health, pursuant to rules\n\npromulgated by the Board, shall:\n\n1. Develop and apply appropriate techniques, including\n\nexaminations and investigations, for determining whether an\n\nindividual meets such standards as established in paragraph 2 of\n\nsubsection A of this section;\n\n2. Certify individuals determined, after the application of\n\nsuch techniques, to meet such standards, and revoke or suspend\n\ncertification previously issued by the Department in any case where\n\nthe individual holding any such certification is determined\n\nsubstantially to have failed to conform to the requirements of such\n\nstandards;\n\n3. Establish and carry out procedures designed to ensure that\n\nindividuals certified as home health agency administrators will,\n\nduring any period that they serve as such, comply with the\n\nrequirements of such standards; and\n\n4. Receive, investigate, and take appropriate action with\n\nrespect to any charge or complaint filed with the Department to the\n\neffect that any individual certified as a home care agency\n\nadministrator has failed to comply with the requirements of such\n\nstandards.\n\nC. 1. In order to further ensure minimum standards for\n\ncertification, the Board shall require a home care agency\n\nadministrator to receive education or training which shall include,\n\nbut not be limited to, training in administration, supervision,\n\nfiscal management, ethics, community relations, public information\n\nand human relations, concerning the issues associated with the\n\noperation of home care agencies and programs. Any person employed\n\nas an administrator after November 1, 1996, shall have completed the\n\neducation or training specified by this subsection.\n\n2. On and after August 1, 1997, proof of successful completion\n\nof the education, training or continuing education, as applicable,\n\nfor the home care agency administrator shall be required prior to\n\nissuance or renewal of a license for a home care agency pursuant to\n\nthe provisions of the Home Care Act.\n\nD. It shall be unlawful and a misdemeanor for any person to act\n\nor serve in the capacity as a home care agency administrator unless\n\nsuch individual is the holder of a certification as a home care\n\nagency administrator, issued in accordance with the provisions of\n\nthe Home Care Act.\n\nE. Each person certified as a home care agency administrator\n\npursuant to the provisions of this section shall be required to pay\n\nan annual certification fee in an amount to be determined by the\n\nState Board of Health not to exceed Two Hundred Dollars ($200.00).\n\nEach such certificate shall expire on the 31st day of July following\n\nits issuance and shall be renewable for twelve (12) months beginning\n\nAugust 1, upon payment of the annual certification fee.\n\nF. In addition to the annual certification fees, the State\n\nBoard of Health may impose fees for training or education programs\n\nconducted or approved by the Board.\n\nG. All revenues collected as a result of fees authorized in\nshall expire on the 31st day of July following\n\nits issuance and shall be renewable for twelve (12) months beginning\n\nAugust 1, upon payment of the annual certification fee.\n\nF. In addition to the annual certification fees, the State\n\nBoard of Health may impose fees for training or education programs\n\nconducted or approved by the Board.\n\nG.
