Stat. tit. 63, § 63-1-1963","heading":"State Department of Health - Powers and duties - Rules","body":"and regulations for investigation and hearing of complaints.\n\nA. The State Department of Health shall have the power and duty\n\nto:\n\n1. Issue, renew, deny, modify, suspend and revoke licenses and\n\ndeny renewal of licenses for agencies, and issue, renew, deny,\n\nmodify, suspend and revoke certificates and deny renewal of\n\ncertificates for home health aides pursuant to the provisions of the\n\nHome Care Act;\n\n2. Establish and enforce qualifications, standards and\n\nrequirements for licensure of home care agencies and certification\n\nof home health aides; provided, nothing in this paragraph shall be\n\nconstrued as to require a hospice to employ a home health aide as a\n\ncondition of licensure;\n\n3. Issue or renew a license to establish or operate a home care\n\nagency if the Department determines that the agency meets the\n\nrequirements of or is accredited or certified by one of the\n\nfollowing accrediting or certifying organizations or programs. In\n\naddition, the accredited home care agency through this paragraph\n\nwill not be subject to an inspection or examination by the\n\nDepartment unless necessary to investigate complaints under\n\nsubsection B of this section:\n\na. Title XVIII or XIX of the federal Social Security Act,\n\nb. the Joint Commission on Accreditation of Healthcare\n\nOrganizations/Home Care Accreditation Services\n\n(JCAHO),\n\nc. the Community Health Accreditation Program of the\n\nNational League for Nursing (CHAP), or\n\nd. the Accreditation Commission for Health Care (ACHC);\n\n4. Establish and maintain a registry of certified home health\n\naides;\n\n5. Enter any home care agency when reasonably necessary for the\n\nsole purpose of inspecting and investigating conditions of the\n\nagency for compliance with the provisions of the Home Care Act, or\n\ncompliance with the standards and requirements for licensure or\n\ncertification developed by the Department pursuant to the provisions\n\nof the Home Care Act;\n\n6. Establish administrative penalties for violations of the\n\nprovisions of the Home Care Act; and\n\n7. Exercise all incidental powers as necessary and proper for\n\nthe administration of the Home Care Act.\n\nB. 1. The State Board of Health shall promulgate rules\n\nnecessary for the investigation and hearing of complaints regarding\n\na home care agency or home health aide.\n\n2. The Department shall establish procedures for receipt and\n\ninvestigation of complaints regarding a home care agency or home\n\nhealth aide.\n\n3.
