Stat. tit. 63, § 63-1-1964","heading":"Contents, coverage and scope of rules","body":"The State Commissioner of Health shall promulgate rules\n\nnecessary to implement the provisions of the Home Care Act. Such\n\nrules shall include, but shall not be limited to:\n\n1. Minimum standards for home care services. In establishing\n\nsuch standards, the Commissioner shall consider those standards\n\nadopted by state and national home care associations;\n\n2. Requirements for the certification and renewal certification\n\nof home health aides and home care agency administrators;\n\n3. Provisions for transfer of ownership of a licensed agency;\n\n4. A requirement that each licensed agency create and disclose\n\nto its clients a statement of clients' rights and responsibilities;\n\n5. Establishing continuing education requirements for renewal\n\nof certifications for home care agency administrators;\n\n6. Requirements for financial resources to ensure a home care\n\nagency's ability to provide adequate home care services;\n\n7. Standards for assessing an applicant's business and\n\nprofessional experience as demonstrated in prior health care\n\nprovider operations including, but not limited to, nursing homes,\n\nresidential care homes, and home care and in previous compliance\n\nwith all lawful orders of suspension, receivership, administrative\n\npenalty or sanction issued by the State Department of Health or by\n\nother administrative agencies in other states with similar\n\nresponsibilities;\n\n8. Restrictions on any agency, agency employee, or agency\n\ncontractor providing skilled care or conducting an in-home\n\nassessment of the need for skilled care unless and until the agency\n\nreceives a healthcare provider's order to provide skilled care or to\n\nconduct an in-home assessment of the need for skilled care;\n\nprovided, however, such restrictions shall not prevent an agency\n\nfrom providing personal care to a client without a healthcare\n\nprovider's order. Provided further, such restrictions shall not\n\napply to in-home assessments of home and community-based waiver\n\nclients in the state Medicaid program;\n\n9. Restrictions on any agency, agency employee, or agency\n\ncontractor soliciting, coercing, or harassing a consumer of home\n\ncare services or who may need home care services; and\n\n10.
