Every person, corporation, partnership, association or other\n\nlegal entity desiring to obtain a license to establish, or to obtain\n\na renewal license to operate, a home care agency in this state shall\n\nmake application to the State Department of Health in such form and\n\naccompanied by such information as the State Commissioner of Health\n\nshall prescribe. Such information shall include, but not be limited\n\nto:\n\n1. The name and location of the home care agency for which a\n\nlicense is sought; and\n\n2. The name and address of the person or persons under whose\n\nownership, operation, management, or supervision the home care\n\nagency will be conducted.\n\nB. 1. An application for an initial license to establish or\n\noperate a new home care agency shall be accompanied by a\n\nnonrefundable application fee of up to Three Thousand Dollars\n\n($3,000.00) not to exceed the reasonable costs incurred by the\n\nDepartment in implementing the Home Care Act.\n\n2. An application for a license, or renewal thereof, to operate\n\nan existing home care agency shall be accompanied by a nonrefundable\n\nlicensing fee of Five Hundred Dollars ($500.00).\n\n3. An application for license, or renewal thereof, to establish\n\nor operate a home care agency branch office of an agency licensed in\n\nthe State of Oklahoma shall be accompanied by a nonrefundable\n\nlicensing fee of Twenty-five Dollars ($25.00).\n\n4. Funds collected pursuant to this section shall be deposited\n\nin the Home Health Care Revolving Fund.\n\nC. Disclosure statements shall be completed by the applicant\n\nand all affiliated persons and such other legal entities specified\n\nby this subsection. The disclosure statements shall be made a part\n\nof the application and shall include, but not be limited to, the\n\nfollowing information:\n\n1. The full name and address of the applicant, and all\n\naffiliated persons;\n\n2. The full name and address of any legal entity in which the\n\napplicant holds a debt or equity interest of at least five percent\n\n(5%) or which is a parent company or subsidiary of the applicant;\n\n3. A description of any ongoing organizational relationships as\n\nthey may impact operations within the state; and\n\n4. The names, locations, and dates of ownership, operation, or\n\nmanagement for all current and prior home care agencies owned,\n\noperated or managed in this state or in any other state by the\n\napplicant or by any affiliated persons.\n\nD. An application for a license for a home care agency may be\n\ndenied by the Commissioner for any of the following reasons:\n\n1. Failure to meet any of the minimum standards of the Home\n\nCare Act or rules of the Board promulgated pursuant thereto; or\n\n2. Conviction of the applicant, or any affiliated persons, for\n\nany offense listed in subsection F of Section 1-1950.1 of this\n\ntitle.\n\nE. The license issued by the Commissioner shall:\n\n1. Not be transferable or assignable except to any affiliated\n\nperson, parent company or subsidiary of the applicant or legal\n\nentity which has an ongoing organizational relationship with the\n\napplicant;\n\n2. Be posted in a conspicuous place, open to the public, on the\n\nlicensed premises;\n\n3. Be issued only for the premises named in the application;\n\nand\n\n4. Except as otherwise provided by this paragraph, expire on\n\nJuly 31 of each year. The Department shall promulgate rules which\n\nwill authorize or allow:\n\na. the term of a renewal license issued pursuant to the\n\nHome Care Act prior to the effective date of this act\n\nwhich will expire prior to July 1, 1997, to be\n\nextended or any application fee or other fee required\n\nby the Home Care Act to be prorated so that a renewal\n\nlicense may be issued on August 1, 1997, and\n\nb. the issuance of a new license, or a renewal license,\n\nprior to or after the effective date of this act to\n\nestablish or operate a home care agency pursuant to\ny 1, 1997, to be\n\nextended or any application fee or other fee required\n\nby the Home Care Act to be prorated so that a renewal\n\nlicense may be issued on August 1, 1997, and\n\nb. the issuance of a new license, or a renewal license,\n\nprior to or after the effective date of this act to\n\nestablish or operate a home care agency pursuant to\n\nthe Home Care Act for less than one (1) year or the\n\nproration of any application fee or other fee so\n\nrequired so that a renewal license may be issued on\n\nAugust 1, 1997.\n\nF. After issuing a license, the Commissioner may revoke or\n\nsuspend the license based on any of the following grounds:\n\n1. Violation of any of the provisions of the Home Care Act or\n\nthe rules or standards promulgated by the Board; or\n\n2. Permitting, aiding, or abetting the commission of any\n\nillegal act by a licensed home care agency.\n\nG. The issuance or renewal of a license after notice of a\n\nviolation shall not constitute a waiver by the Department of its\n\npower to rely on the violation as the basis for subsequent\n\nrevocation of a license or other enforcement action authorized by\n\nthe Home Care Act.\n\nH. For purposes of this section:\n\n1. \"Affiliated person\" means:\n\na. any officer, director or partner of the applicant,\n\nb. any person employed by the applicant as a general or\n\nkey manager who directs the operations of the facility\n\nwhich is the subject of the application, and\n\nc. any person owning or controlling more than five\n\npercent (5%) of the applicant's debt or equity; and\n\n2. \"Subsidiary\" means any person, firm, corporation or other\n\nlegal entity which:\n\na. controls or is controlled by the applicant,\n\nb. is controlled by an entity that also controls the\n\napplicant, or\n\nc. the applicant or an entity controlling the applicant\n\nhas directly or indirectly the power to control.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"c99a8cab22a912b6a5166ef68de4489d1c50241b84327a3bbfa59eb7390d057f","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-1-1964","next":"us-ok/okla.-stat.-tit.-63-63-1-1966"},"notice":"GroundRules: Original legal text.
