Stat. tit. 63, § 63-1-209","heading":"Cities and towns - Health authorities - Licensing and","body":"Inspection - Ordinances.\n\nA. 1. Except as may be otherwise provided by city charter, the\n\ngoverning board of each city or incorporated town shall serve, ex\n\nofficio, as the board of health for such city or town, and shall\n\nappoint, and fix the duties and compensation of, a health officer\n\nand other personnel to enforce the ordinances of such city or town\n\nrelating to public health.\n\n2. Except as otherwise provided by this subsection, the\n\ngoverning board may adopt such ordinances and rules as it deems\n\nnecessary for the protection of the public health, provided such\n\nordinances and rules are not inconsistent with state laws or rules\n\nof the State Board of Health. The governing board shall enforce\n\nsuch laws and rules as may be required by the State Commissioner of\n\nHealth and may, by agreement with the medical director of the county\n\nor district department of health, delegate to such department the\n\nauthority to enforce ordinances of the city or town relating to\n\npublic health. Except as otherwise provided by law, responsibility\n\nfor licensing, regulation and inspection of nursing facilities and\n\nspecialized facilities, as defined in the Nursing Home Care Act and\n\nfor enforcement of state health and safety standards applicable to\n\nsuch facilities, shall be reserved to the State Department of Health\n\nand shall be exercised pursuant to the provisions of the Nursing\n\nHome Care Act.\n\n3. Except as otherwise provided by law, responsibility for the\n\nlicensing and inspection of any establishment where food or drink is\n\noffered for sale or sold, in accordance with the provisions of\n\nSection 1-1118 of this title, and for the enforcement of state\n\nhealth and safety standards applicable to such establishments, shall\n\nbe reserved to the State Department of Health. Any such rules\n\nadopted by a governing body of a city or town relating to an\n\nestablishment where food or drink is offered for sale or sold shall\n\nnot be more stringent than the rules for such establishments adopted\n\nby the State Board of Health; provided, that rules adopted prior to\n\nMay 31, 2008, which directly relate to training and permit\n\nrequirements for food managers and food handlers and fees related to\n\nsuch establishments shall, in addition to the license fee required\n\nby the State Board of Health, be exempt from the provisions of this\n\nsubsection.\n\nB. The governing board of each city or incorporated town may\n\nadopt and enforce such ordinances as it deems necessary for the\n\nprotection of the environment, provided such ordinances are not\n\ninconsistent with state laws or rules of the Environmental Quality\n\nBoard.
