The board of county commissioners in any county that\n\nqualifies under Section 210 of this article is hereby authorized and\n\nempowered to make and enforce all reasonable rules and regulations\n\nwith regard to the preservation and promotion of public health;\n\nprovided, that any such rules or regulations shall have first been\n\nrecommended or approved by the city-county board of health, and\n\nfurther provided that such rules and regulations shall not be\n\ninconsistent with state laws or rules and regulations of the State\n\nBoard of Health. Such rules and regulations shall be operative\n\nthroughout the county, except within the limits of incorporated\n\ncities and towns. Any such rules adopted by county commissioners\n\nrelating to an establishment where food or drink is offered for sale\n\nor sold shall not be more stringent than the rules for such\n\nestablishments adopted by the State Board of Health; provided, that\n\nrules adopted prior to May 31, 2008, which directly relate to\n\ntraining and permit requirements for food managers and food handlers\n\nand fees related to such establishments shall, in addition to the\n\nlicense fee required by the State Board of Health, be exempt from\n\nthe provisions of this subsection.\n\nB. The board of county commissioners is also authorized to\n\nprovide for the levying and collection of fees for services\n\nperformed by such city-county health department outside the\n\nboundaries of incorporated cities and towns within such county.
