Stat. tit. 63, § 63-1-2213.1","heading":"Office of the State Long-Term Care Ombudsman —","body":"Transfer to Office of Attorney General.\n\nA. Upon the effective date of this act, the Office of the State\n\nLong-Term Care Ombudsman within the Department of Human Services\n\nshall transfer to the Office of the Attorney General. The Office of\n\nthe State Long-Term Care Ombudsman shall continue to exercise its\n\nstatutory powers and duties.\n\nB. All equipment, supplies, records, matters pending, assets,\n\nfuture liabilities, fund balances, encumbrances, obligations,\n\nindebtedness, and legal and contractual rights and responsibilities\n\nof the Office of the State Long-Term Care Ombudsman shall be\n\ntransferred to the Office of the Attorney General.\n\nC. Any monies accruing to or in the name of the Office of the\n\nState Long-Term Care Ombudsman on and after the effective date of\n\nthis act, or any monies that accrue in any funds or accounts or are\n\nmaintained for the benefit of the Office on and after the effective\n\ndate of this act, shall be transferred to the Office of the Attorney\n\nGeneral.\n\nD. The Department of Human Services and the Office of the\n\nAttorney General may enter into an agreement for the transfer of\n\npersonnel. No employee shall be transferred to the Office of the\n\nAttorney General except on the freely given written consent of the\n\nemployee. Any employee who is transferred shall not be required to\n\naccept a lesser grade or salary than presently received. All\n\nemployees shall retain leave, sick, and annual time earned, and any\n\nretirement and longevity benefits which have accrued during their\n\ntenure with the Department of Human Services. The transfer of\n\npersonnel between the state agencies shall be coordinated with the\n\nOffice of Management and Enterprise Services.\n\nE. The Director of the Office of Management and Enterprise\n\nServices shall coordinate the transfer of funds, allotments,\n\npurchase orders, and outstanding financial obligations or\n\nencumbrances as provided for in this section.\n\nF. Upon the effective date of this act, all administrative\n\nrules promulgated by the Director of Human Services for the Office\n\nof the State Long-Term Care Ombudsman shall be transferred to and\n\nbecome a part of the administrative rules of the Office of the\n\nAttorney General. The Office of Administrative Rules in the Office\n\nof the Secretary of State shall provide adequate notice in “The\n\nOklahoma Register” of the transfer of such rules and shall place the\n\ntransferred rules under the Oklahoma Administrative Code title of\n\nthe Office of the Attorney General.
