Stat. tit. 63, § 63-1-2216","heading":"Promulgation of rules by Attorney General — Advisory","body":"capacity of State Council on Aging and Adult Protective Services.\n\nA. The Attorney General shall promulgate rules regarding:\n\n1. The powers and official duties of the State Long-Term Care\n\nOmbudsman consistent with applicable federal law and rules or as\n\nprovided by the Long-Term Care Ombudsman Act;\n\n2. Minimum qualifications for persons to serve as\n\nrepresentatives of the Office of the State Long-Term Care Ombudsman;\n\n3. Initial and continuing training requirements for ombudsman\n\nstaff and volunteers which shall provide for a minimum of eighteen\n\n(18) hours of continuing education relevant to the care of the aging\n\nand disabled;\n\n4. The minimum number of visits that must be made by an\n\nombudsman to the assigned facilities;\n\n5. The proper documentation and reporting of visits made to\n\nfacilities by the ombudsman;\n\n6. Procedures to ensure that officers, employees, or other\n\nrepresentatives of the Office are not subject to a conflict of\n\ninterest which would impair their ability to carry out their\n\nofficial duties in an impartial manner; and\n\n7. The disclosure by the State Long-Term Care Ombudsman or area\n\nor local Ombudsman entities of files maintained by the State Long-\n\nTerm Care Ombudsman Program. Such rules shall:\n\na. provide that such files and records may be disclosed\n\nonly at the discretion of the State Long-Term Care\n\nOmbudsman or the person designated by the State Long-\n\nTerm Care Ombudsman to disclose the files and records,\n\nand\n\nb. prohibit the disclosure of the identity of any\n\ncomplainant or resident with respect to whom the\n\nOffice maintains such files or records unless:\n\n(1) the complainant or resident, or the legal\n\nrepresentative of the complainant or resident,\n\nconsents to the disclosure and the consent is\n\ngiven in writing,\n\n(2) (a) the complainant or resident gives consent\n\norally, and\n\n(b) the consent is documented contemporaneously\n\nin a writing made by a State Long-Term Care\n\nOmbudsman representative of the Office in\n\naccordance with such rules as the Attorney\n\nGeneral shall promulgate, or\n\n(3) the disclosure is required by court order.\n\nB. The Oklahoma State Council on Aging and Adult Protective\n\nServices, established by the Department of Human Services to review,\n\nmonitor, and evaluate programs targeted to older persons, shall\n\nserve in an advisory capacity to the State Long-Term Care Ombudsman\n\nthrough establishment of a committee with equal provider and\n\nconsumer representation.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"9c7cf9f6c8992ab0e6cfb24f5475ad62f4a7cd0916a9cbff0aa65fa1df1c9491","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-1-2215","next":"us-ok/okla.-stat.-tit.-63-63-1-2217"},"notice":"GroundRules: Original legal text.
