Stat. tit. 63, § 63-1-229.12","heading":"Definitions","body":"As used in the Prevention of Youth Access to Tobacco Act:\n\n1. \"Nicotine product\" means any product that contains nicotine\n\nextracted or isolated from plants, vegetables, fruit, herbs, weeds,\n\ngenetically modified organic matter, or that is synthetic in origin\n\nand is intended for human consumption; provided, however, this term\n\nshall not include products approved by the United States Food and\n\nDrug Administration for smoking cessation;\n\n2. \"Person\" means any individual, firm, fiduciary, partnership,\n\ncorporation, trust, or association, however formed;\n\n3. \"Proof of age\" means a driver license, license for\n\nidentification only, or other generally accepted means of\n\nidentification that describes the individual as twenty-one (21)\n\nyears of age or older and contains a photograph or other likeness of\n\nthe individual and appears on its face to be valid;\n\n4. \"Sample\" means a tobacco product, nicotine product or vapor\n\nproduct distributed to members of the public at no cost for the\n\npurpose of promoting the product;\n\n5. \"Sampling\" means the distribution of samples to members of\n\nthe public in a public place;\n\n6. \"Tobacco product\" means any product that contains tobacco\n\nand is intended for human consumption;\n\n7. \"Transaction scan\" means the process by which a seller\n\nchecks, by means of a transaction scan device, the validity of a\n\ndriver license or other government-issued photo identification;\n\n8. \"Transaction scan device\" means any commercial device or\n\ncombination of devices used at a point of sale or entry that is\n\ncapable of deciphering in an electronically readable format the\n\ninformation encoded on the magnetic strip or bar code of a driver\n\nlicense or other government-issued photo identification; and\n\n9. \"Vapor product\" shall mean noncombustible products, that may\n\nor may not contain nicotine, that employ a mechanical heating\n\nelement, battery, electronic circuit, or other mechanism, regardless\n\nof shape or size, that can be used to produce a vapor in a solution\n\nor other form. \"Vapor products\" shall include any vapor cartridge\n\nor other container with or without nicotine or other form that is\n\nintended to be used with an electronic cigarette, electronic cigar,\n\nelectronic cigarillo, electronic pipe, or similar product or device\n\nand any vapor cartridge or other container of a solution, that may\n\nor may not contain nicotine, that is intended to be used with or in\n\nan electronic cigarette, electronic cigar, electronic cigarillo or\n\nelectronic device. \"Vapor products\" do not include any products\n\nregulated by the United States Food and Drug Administration under\n\nChapter V of the Food, Drug, and Cosmetic Act.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"56472b1f79d1d7f531b8ba5e14ac6dc8c23921f69a0af02b96e443921e06f3df","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-1-229.11","next":"us-ok/okla.-stat.-tit.-63-63-1-229.13"},"notice":"GroundRules: Original legal text.
