It shall be unlawful for any person or retailer to\n\ndistribute tobacco products, nicotine products, vapor products or\n\nproduct samples to any person under twenty-one (21) years of age.\n\nB. No person shall distribute tobacco products, nicotine\n\nproducts, vapor products or product samples in or on any public\n\nstreet, sidewalk, or park that is within three hundred (300) feet of\n\nany playground, school, or other facility when the facility is being\n\nused primarily by persons under twenty-one (21) years of age.\n\nC. When a person violates any provision of subsection A or B of\n\nthis section, the Alcoholic Beverage Laws Enforcement (ABLE)\n\nCommission shall impose an administrative fine of:\n\n1. Not more than One Hundred Dollars ($100.00) for the first\n\noffense;\n\n2. Not more than Two Hundred Dollars ($200.00) for the second\n\noffense; and\n\n3. Not more than Three Hundred Dollars ($300.00) for a third or\n\nsubsequent offense.\n\nD. Upon failure of any person to pay an administrative fine\n\nwithin ninety (90) days of the assessment of the fine, the ABLE\n\nCommission shall notify the Department of Public Safety, and the\n\nDepartment shall suspend or not issue a driver license to the person\n\nuntil proof of payment has been furnished to the Department of\n\nPublic Safety.\n\nE.
