Beginning July 1, 2023, every manufacturer of a vapor\n\nproduct that is sold or intended to be sold in this state, whether\n\ndirectly or through a distributor, retailer, or similar intermediary\n\nor intermediaries, shall execute and deliver an attestation under\n\npenalty of perjury to the Oklahoma Alcoholic Beverage Laws\n\nEnforcement (ABLE) Commission certifying that, as of the date of\n\nsuch attestation:\n\n1. The vapor product was available for purchase in the United\n\nStates as of August 8, 2016, and the manufacturer has applied for a\n\nmarketing order for the vapor product by submitting a Premarket\n\nTobacco Product Application on or before September 9, 2020, to the\n\nUnited States Food and Drug Administration (FDA); or\n\n2. The manufacturer has received a marketing order or other\n\nauthorization for the vapor product from the FDA pursuant to Section\n\n387j of Title 21 of the United States Code.\n\nB. The manufacturer shall notify the ABLE Commission within\n\nthirty (30) days of any material change to the attestation,\n\nincluding whether the FDA has issued or not issued a market order or\n\nother authorization or has ordered the manufacturer to remove the\n\nvapor product, either temporarily or permanently, from the United\n\nStates market.\n\nC. The ABLE Commission shall develop a directory listing all of\n\nthe manufacturers that have provided attestations that comply with\n\nsubsection A of this section and all vapor products that are listed\n\nin such attestations. The ABLE Commission shall:\n\n1. Make the directory available for public inspection on its\n\nwebsite on or before October 1, 2023; and\n\n2. Update the directory as necessary to correct mistakes and to\n\nadd or remove manufacturers or vapor products to maintain the\n\ndirectory in conformity with the requirements of this section.\n\nD.
