Stat. tit. 63, § 63-1-229.5","heading":"Review and recommendation of State Plan for Tobacco","body":"Use Prevention and Cessation – Invitations to bid for program\n\ncontract proposals – Evaluations – Youth Tobacco Survey.\n\nA. On or before January 1, 2002, the Department, giving\n\nconsideration to the recommendations of the Advancement of Wellness\n\nAdvisory Council created in Section 44 of this act, shall review and\n\nrecommend a State Plan for Tobacco Use Prevention and Cessation that\n\nis in compliance with nationally recognized guidelines or scientific\n\nevidence of effectiveness. On or before January 1 of each year, the\n\nState Department of Health may propose amendments to the plan. The\n\nDepartment shall submit its proposed State Plan or any proposed\n\namendments thereto to the Governor, the Speaker of the House of\n\nRepresentatives, the President Pro Tempore of the Senate, and the\n\nAttorney General. The Governor, members of the Legislature, and the\n\nAttorney General may submit comments to the Department on its\n\nproposed amendments to the State Plan on or before March 1 of each\n\nyear. On or before May 1 of each year, the Department shall make\n\nsuch amended State Plan public.\n\nB. The State Plan shall set out the criteria by which\n\nInvitations To Bid and applications for contract proposals are\n\nconsidered. Such plan shall also describe the types of tobacco use\n\nprevention or cessation programs that shall be eligible for\n\nconsideration for contracts from the Fund utilizing only those\n\nprograms that are in compliance with nationally recognized\n\nguidelines, or scientific evidence of effectiveness. Such eligible\n\nprograms shall include, but not be limited to:\n\n1. Media campaigns directed to youth to prevent underage\n\ntobacco use;\n\n2. School-based education programs to prevent youth tobacco\n\nuse;\n\n3. Community-based youth programs involving tobacco use\n\nprevention through general youth development;\n\n4. Enforcement and administration of the Prevention of Youth\n\nAccess to Tobacco Act, and related retailer education and compliance\n\nefforts;\n\n5. Cessation programs for youth; and\n\n6. Prevention or cessation programs for adults.\n\nC. The State Plan shall provide that no less than seventy\n\npercent (70%) of the dollar value of the contracts awarded in each\n\nyear shall be dedicated to programs described in paragraphs 1\n\nthrough 5 of subsection B of this section.\n\nD. The State Plan shall provide for the evaluation of all\n\nfunded programs to determine their overall effectiveness in\n\npreventing or reducing tobacco use according to the program's stated\n\ngoals.\n\nAn annual evaluation shall be provided by an independent\n\ncontractor to determine the effectiveness of the programs by\n\nmeasuring the following:\n\n1. Tobacco consumption;\n\n2. Smoking rates among the population targeted by the programs;\n\nand\n\n3. The specific effectiveness of any other program funded.\n\nSuch evaluation shall also be compared with initial baseline\n\ndata collected prior to the creation of this act, and data from\n\nprevious years if it is a multiyear program.\n\nE. The State Plan further shall provide for administration of\n\nthe Oklahoma Youth Tobacco Survey to measure tobacco use and\n\nbehaviors towards tobacco use by individuals in grades six through\n\ntwelve. Such survey shall:\n\n1. Involve a statistically valid sample of the individuals in\n\neach of grades six through twelve;\n\n2. Be made available to the public, along with the resulting\n\ndata, excluding respondent identities and respondent-identifiable\n\ndata, within sixty (60) days of completion of the survey; and\n\n3.
