Stat. tit. 63, § 63-1-233","heading":"Providers as state employees - Protection from liability","body":"- Employment contracts.\n\nA. Persons licensed to practice medicine and surgery or who are\n\nlicensed osteopathic physicians and surgeons or who are certified\n\nnurse-midwives, advanced nurse practitioners and who provide\n\nprenatal, delivery, infant care services and other child or adult\n\nhealth services to State Department of Health clients pursuant to\n\nand in strict compliance with all terms of a contract with the State\n\nDepartment of Health authorized by paragraph 3 of subsection B of\n\nSection 1-106 of this title, shall be considered employees of the\n\nstate for purposes of The Governmental Tort Claims Act only, but\n\nonly insofar as actions within the employee's scope of employment as\n\nspecified by the terms of the contract.\n\nB. Such contracts shall provide that any prenatal, delivery and\n\ninfant care services rendered by the provider shall fully comply\n\nwith the Standards for Ambulatory Obstetrical Care of the American\n\nCollege of Obstetrics and Gynecology and the Perinatal Care\n\nGuidelines of the American College of Obstetrics and Gynecology and\n\nthe American Academy of Pediatrics as adopted and incorporated into\n\nthe Standards and Guidelines for Public Providers of Maternity\n\nServices of the State Department of Health in order to entitle the\n\nprovider to the limited liability provided by subsection A of this\n\nsection.\n\nC. Any contract executed pursuant to this section shall state\n\nwith specificity, the exact services to be provided and the\n\nparticular services which shall entitle the provider to the limited\n\nliability provided by subsection A of this section.\n\nD. Any services provided or contracts entered into pursuant to\n\nthis act shall include only those activities designed to promote the\n\nhealthiest possible outcomes for mother and child. The prenatal and\n\npostnatal services provided with these funds shall be used solely to\n\nprovide health care services for pregnant women, decrease infant\n\nmortality and facilitate the birth of a live child. For purposes of\n\nthis act, “health care services” does not include abortion, abortion\n\nreferral, or abortion counseling.
