{"data":{"id":"us-ok/okla.-stat.-tit.-63-63-1-242.2","jurisdiction":"us-ok","citation":"Okla. Stat. tit. 63, § 63-1-242.2","heading":"Maternal Mortality Review Committee","body":"A. There is hereby created, to continue until November 1, 2029,\n\nthe Maternal Mortality Review Committee. The Committee shall have\n\nthe power and duty to:\n\n1. Conduct case reviews of the pregnancy-related and pregnancy-\n\nassociated maternal deaths of women in Oklahoma;\n\n2. Improve the ability to provide high-quality, evidence-based\n\nhealth care to women and infants in Oklahoma;\n\n3. Identify gaps in the provision of health care services\n\nincluding, but not limited to, quality of care, access to the most\n\nappropriate health care, transportation and lack of financial\n\nresources;\n\n4. Review probable cause of death and identify contributing\n\nfactors;\n\n5. Decide if the death was preventable, and if so what actions\n\ncould have been taken to prevent the death;\n\n6. Identify action items related to issues identified to\n\nimprove the provision of health care and prevent future maternal\n\ndeaths;\n\n7. Enter into agreements with other state, local and private\n\nentities as necessary to carry out the duties of the Committee; and\n\n8. Recommend rules to be promulgated as needed to and by the\n\nState Commissioner of Health.\n\nB. In carrying out its duties and responsibilities the\n\nCommittee shall:\n\n1. Establish criteria for case review involving pregnancy-\n\nrelated and pregnancy-associated maternal death or near death\n\nsubject to specific, in-depth review by the Committee;\n\n2. Conduct review for all cases identified as pregnancy-related\n\nand pregnancy-associated maternal deaths or near deaths where\n\nsufficient information is obtainable to evaluate the case;\n\n3. Establish and maintain statistical information related to\n\nthe deaths and near deaths necessary to compile data and identify\n\ngaps in services or areas subject to improvement in the provision of\n\nhealth care;\n\n4. Establish procedures for obtaining information related to\n\nthe deaths necessary to accurately determine cause of death,\n\ncontributing factors, gaps in service and areas subject to\n\nimprovement in the provision of health care;\n\n5. Contact family members and other affected or involved\n\npersons to collect additional relevant data;\n\n6. Request and obtain a copy of all records and reports\n\npertaining to the pregnancy-related and pregnancy-associated\n\nmaternal mortality or near-death case under review. All case\n\nreviews shall remain in the possession of Committee staff and only\n\nde-identified information will be presented to the Committee,\n\nincluding but not limited to the following:\n\na. medical examiner reports,\n\nb. hospital/health care entity records,\n\nc. court records,\n\nd. prosecutorial records,\n\ne. local, state, and federal law enforcement records\n\nincluding, but not limited to, the Oklahoma State\n\nBureau of Investigation,\n\nf. fire department records,\n\ng. State Department of Health records, including birth\n\nand death certificate records,\n\nh. medical and dental records,\n\ni. Department of Mental Health and Substance Abuse\n\nServices and other mental health records,\n\nj. emergency medical service records, and\n\nk. pharmacy records.\n\nConfidential information provided to the Committee shall be\n\nmaintained by the Committee in a confidential manner as otherwise\n\nrequired by state and federal law. Any person damaged by disclosure\n\nof such confidential information by the Committee or its members\n\nwhich is not authorized by law may maintain an action for damages,\n\ncosts and attorney fees pursuant to The Governmental Tort Claims\n\nAct; and\n\n7. Maintain all confidential information, documents and records\n\nin possession of the Committee as confidential and not subject to\n\nsubpoena or discovery in any civil or criminal proceedings; provided\n\nhowever, information, documents and records otherwise available from\n\nother sources shall not be exempt from subpoena or discovery through\n\nthose sources solely because such information, documents and records\nn all confidential information, documents and records\n\nin possession of the Committee as confidential and not subject to\n\nsubpoena or discovery in any civil or criminal proceedings; provided\n\nhowever, information, documents and records otherwise available from\n\nother sources shall not be exempt from subpoena or discovery through\n\nthose sources solely because such information, documents and records\n\nwere presented to or reviewed by the Committee.\n\nC. The review and discussion of individual cases of pregnancy-\n\nrelated and pregnancy-associated maternal death or near death shall\n\nbe conducted in executive session. Any discussion of individual\n\ncases and any writing produced by or created by the Committee as the\n\nresult of its review shall be privileged and shall not be admissible\n\nin evidence in any proceeding. All other business shall be\n\nconducted in accordance with the provisions of the Oklahoma Open\n\nMeeting Act.\n\nD. A health care provider, health care facility, pharmacy or\n\nany other entity providing access to medical records pursuant to\n\nthis statute shall not be held liable for civil damages or be\n\nsubject to any criminal or disciplinary action for good-faith\n\nefforts in providing such records.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"2138611b1ff8786ea083c4d2fac59a1cab9523c86dd1d8cbb8cdec75c7ba3c82","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-1-242.1","next":"us-ok/okla.-stat.-tit.-63-63-1-242.3"},"notice":"GroundRules: Original legal text.
