As used in this section:\n\n1. “Certified alcohol and drug counselor” means any person who\n\nis not exempt pursuant to the provisions of Section 1872 of Title 59\n\nof the Oklahoma Statutes and is not licensed under the Licensed\n\nAlcohol and Drug Counselors Act, but who provides alcohol and drug\n\ncounseling services within the scope of practice while employed by\n\nan entity certified by the Department of Mental Health and Substance\n\nAbuse Services, or who is exempt from such certification, or who is\n\nunder the supervision of a person recognized by the Oklahoma Board\n\nof Licensed Alcohol and Drug Counselors as a supervisor. A\n\ncertified alcohol and drug counselor may provide counseling services\n\nfor co-occurring disorders if he or she has been certified by the\n\nBoard to provide counseling as provided in this section for co-\n\noccurring disorders;\n\n2. “Emergency opioid antagonist” means a drug including, but\n\nnot limited to, naloxone that blocks the effects of opioids and that\n\nis approved by the United States Food and Drug Administration for\n\nthe treatment of an opioid overdose;\n\n3. “Licensed alcohol and drug counselor” means any person who\n\nprovides alcohol and drug counseling services within the scope of\n\npractice, including co-occurring disorders, for compensation to any\n\nperson and is licensed pursuant to the provisions of the Licensed\n\nAlcohol and Drug Counselors Act. The term licensed alcohol and drug\n\ncounselor shall not include those professions exempted by Section\n\n1872 of Title 59 of the Oklahoma Statutes; and\n\n4. “Medical personnel at schools” means a certified school\n\nnurse or any other nurse employed by or under contract with a\n\nschool, any licensed practitioner of the healing arts, or any person\n\ndesignated by the school administration to administer an emergency\n\nopioid antagonist in the event of a suspected overdose pursuant to\n\nSection 1210.242 of Title 70 of the Oklahoma Statutes.\n\nB. First responders shall have the authority to administer,\n\nwithout prescription, emergency opioid antagonists when encountering\n\nan individual exhibiting signs of an opioid overdose.\n\nC. First responders may provide, without prescription,\n\nemergency opioid antagonists to individuals who have experienced or\n\nwitnessed an opioid overdose for use by those individuals at a later\n\ndate.\n\nD. For the purposes of this section, a first responder shall\n\ninclude:\n\n1. Law enforcement officials;\n\n2. Emergency medical technicians;\n\n3. Firefighters;\n\n4. Medical personnel at schools including any public or charter\n\nschools, technology center schools and institutions of higher\n\neducation;\n\n5. Forensic laboratory personnel of the Oklahoma State Bureau\n\nof Investigation as designated by the Director;\n\n6. Personnel of the Department of Corrections or of any entity\n\nthat contracts with the Department of Corrections to provide housing\n\nor services for inmates of the Department of Corrections; and\n\n7. Certified alcohol and drug counselors and licensed alcohol\n\nand drug counselors.\n\nE. Any first responder who administers or provides an emergency\n\nopioid antagonist in good faith and in a manner consistent with\n\naddressing opioid overdose shall not be liable for any civil damages\n\nas a result of any acts or omissions by such first responder except\n\nfor committing gross negligence or willful wanton wrongs in\n\nadministering or providing such emergency opioid antagonist.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"f38271971c65044cf951b37eb4937348cf32a6f80125d3ce2ae946ec69f6b28d","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-1-2506","next":"us-ok/okla.-stat.-tit.-63-63-1-2506.2"},"notice":"GroundRules: Original legal text.
