Stat. tit. 63, § 63-1-2509","heading":"Operation of ambulance service - Violation of act -","body":"Penalties - Public nuisance - Injunctions.\n\nA. 1. No person, company, governmental entity or trust\n\nauthority may operate an ambulance service within this state except\n\nas provided in this section. The State Commissioner of Health, the\n\ndistrict attorney of the county wherein the ambulance service\n\noperates or may be found, or the Attorney General of this state\n\nshall have the authority to bring an action to enjoin the operation\n\nof any ambulance service not in compliance with the provisions of\n\nthis act.\n\n2. A ground ambulance service based outside of this state that\n\nis licensed and in good standing in its home state may respond to an\n\nemergency request for care and transport of a patient within this\n\nstate provided no local licensed ambulance service is readily\n\navailable, and may be exempt from the licensing requirements of this\n\nstate pursuant to rules promulgated by the State Board of Health.\n\n3. Requests for service must be referred by an Oklahoma\n\nemergency dispatch center. The Board may require such exempt\n\nambulance service to subsequently provide documentation of emergency\n\nresponse activities performed within this state.\n\n4. The State Department of Health shall have the authority to\n\ninvestigate any complaint associated with an emergency response by\n\nan out-of-state ambulance service in the same manner as ambulance\n\nservices licensed by the Department within this state.\n\nB. The Commissioner shall have the authority to revoke or\n\nsuspend any license, to issue probationary licenses, or to levy such\n\nadministrative fines and penalties as may be deemed necessary, for\n\nviolations of the provisions of this act, subject to the provisions\n\nof the Administrative Procedures Act. The powers afforded the\n\nCommissioner within the general enforcement provisions of the Public\n\nHealth Code are additionally incorporated herein.\n\nC. In addition to any other penalties, any person, company,\n\ngovernmental entity or trust authority who violates any of the\n\nprovisions of this act relating to compliance with the provisions of\n\nthis act or of standards, specifications, procedures and rules\n\nadopted by the Board may be punished by the assessment of a civil\n\npenalty of not more than One Hundred Dollars ($100.00) for each\n\nviolation. Each day a violation continues shall be considered a\n\nseparate offense.\n\nD. The operation or maintenance of an ambulance service in\n\nviolation of this act, or the rules promulgated by the Board, is\n\ndeclared a public nuisance inimical to the public welfare. The\n\nCommissioner in the name of the people of the state, through the\n\nAttorney General, or the district attorney of the county in which\n\nthe ambulance service is located, may, in addition to other remedies\n\nherein provided, bring action for an injunction to restrain such\n\nviolation or to enjoin the future operation or maintenance of any\n\nsuch ambulance service.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"47dc6301874a33b3fd8dfedc249816a7d32a317dd9d9a84b23ba1b1c5d779ebf","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-1-2506.2","next":"us-ok/okla.-stat.-tit.-63-63-1-2509.1"},"notice":"GroundRules: Original legal text.
