Stat. tit. 63, § 63-1-2515","heading":"EMS Regions, Ambulance Service districts or","body":"municipalities - Regulation and control of Ambulance Service\n\ntransports - Exemptions.\n\nA. Notwithstanding any other provision of this title, Emergency\n\nMedical Services (EMS) Regions, Ambulance Service districts or\n\nmunicipalities are hereby authorized to regulate and control,\n\npursuant to duly enacted ordinance or regulation, Ambulance Service\n\ntransports originating within the jurisdiction of such EMS Regions,\n\nAmbulance Service districts or municipalities.\n\nB. Any ordinance or regulation adopted pursuant to subsection A\n\nof this section shall meet and may exceed, but shall not be in\n\ncontravention of, the standards promulgated by the State Board of\n\nHealth for Ambulance Service transports.\n\nC. 1. Any ordinance or regulation adopted by an EMS Region,\n\nAmbulance Service district or a municipality may establish a sole-\n\nprovider system for stretcher van and/or Ambulance Service\n\ntransports; provided, however, any such designated or contracted\n\nsole-provider which is not an EMS Region, Ambulance Service\n\ndistrict, municipality, or other public entity shall be selected by\n\ncompetitive bidding.\n\n2. A contract entered into pursuant to such bidding shall be\n\nwith the lowest and best bidder and may be for an initial term of\n\nsuch duration as deemed operationally and fiscally prudent by the\n\ncontracting agency. The term of such sole-provider contract shall\n\nbe made public at the time bids are solicited, which solicitation\n\nshall be not less than sixty (60) days prior to the contract start\n\ndate.\n\nD. Any EMS Region, Ambulance Service district or municipality\n\nmay establish a sole-provider system for stretcher van and/or\n\nAmbulance Service transports and may allow additional geographic or\n\npolitical subdivisions to join such a system at any time. Whenever\n\nsuch a geographic or political subdivision joins such a sole-\n\nprovider system, competitive bidding shall not be required and\n\nprovision for servicing the new jurisdiction may be accomplished by\n\namending the existing sole-provider contract. Furthermore, in the\n\nevent the expansion of the service area of the EMS Region, Ambulance\n\nService district or the municipality is substantial (in the sole\n\nopinion of the governing body of the EMS Region, Ambulance Service\n\ndistrict or municipality), the existing sole-provider contract may\n\nbe extended for a period sufficient to allow reasonable opportunity\n\nfor recovery of capital costs of expansion, as determined by the\n\ncontracting agency.\n\nE. The provisions of this section shall not be construed or\n\napplied to limit the operation of any emergency medical service\n\ndistrict established and operating pursuant to Section 9C of Article\n\n10 of the Oklahoma Constitution; provided, however, that, upon\n\ninvitation and approval of a majority of the voters of the district,\n\nany such district is hereby authorized to join by appropriate\n\nagreement any system established by an EMS Region, Ambulance Service\n\ndistrict or a municipality pursuant to the provisions of this\n\nsection.\n\nF. The following types of patient transports shall be exempt\n\nfrom regulation by EMS Regions, Ambulance Service districts or\n\nmunicipalities:\n\n1. Any ambulance owned or operated by, or under contract to\n\nperform ambulance transport services for, the Federal or State\n\ngovernment, or any agency thereof;\n\n2. Any ambulance owned and operated by a hospital and in use to\n\ntransport a patient of the owner-hospital, which patient has been\n\nadmitted to and not been discharged from the owner-hospital, to or\n\nfrom another hospital or medical care facility at which the patient\n\nreceives a diagnostic or therapeutic procedure not available at the\n\nowner-hospital;\n\n3. Any ambulance engaged in a routine transport call to\n\ntransport a patient from a hospital, nursing home, or dialysis\n\ncenter located within an EMS Region, Ambulance Service district or\nother hospital or medical care facility at which the patient\n\nreceives a diagnostic or therapeutic procedure not available at the\n\nowner-hospital;\n\n3. Any ambulance engaged in a routine transport call to\n\ntransport a patient from a hospital, nursing home, or dialysis\n\ncenter located within an EMS Region, Ambulance Service district or\n\nmunicipality to any location outside the EMS Region, Ambulance\n\nService district or municipality;\n\n4. Any ambulance engaged in the transport of a patient from a\n\nlocation outside an EMS Region, Ambulance Service district or\n\nmunicipality to a location inside an EMS Region, Ambulance Service\n\ndistrict or municipality; or\n\n5.
