Stat. tit. 63, § 63-1-2530.3","heading":"Rules - Classification of trauma and emergency care -","body":"Requirements for distribution of trauma patients.\n\nA. The State Board of Health, giving consideration to the\n\nrecommendations of the Trauma and Emergency Response Advisory\n\nCouncil created in Section 1-103a.1 of this title, shall promulgate\n\nrules establishing minimum standards and objectives to implement the\n\ndevelopment, regulation and improvement of trauma systems on a\n\nstatewide basis. Rules shall provide for the classification of\n\ntrauma and emergency care provided by all hospitals based on the\n\nlevel of service provided and for triage, transport and transfer\n\nguidelines. The Board shall consider guidelines developed by the\n\nAmerican College of Surgeons in promulgating rules under this\n\nsection.\n\nB. The rules shall provide specific requirements for the\n\ndistribution of trauma patients, ensure that trauma care is fully\n\ncoordinated with all hospitals and emergency medical services in a\n\nregional area, and reflect the geographic areas of the state,\n\nconsidering time and distance.\n\nC. The rules shall include:\n\n1. Pre-hospital care management guidelines for triage and\n\ntransport of trauma patients;\n\n2. Establishment of referral patterns of trauma patients and\n\ngeographic boundaries regarding trauma patients;\n\n3. Requirements for licensed hospitals providing trauma and\n\nemergency operative services to provide quality care to trauma\n\npatients referred to these facilities;\n\n4. Minimum requirements for resources and equipment needed by a\n\ntrauma and emergency operative services facility to treat trauma\n\npatients;\n\n5. Minimum standards for the availability and qualifications of\n\nhealth care personnel, including physicians and surgeons, treating\n\ntrauma patients within a hospital;\n\n6. Minimum requirements for data collection including, but not\n\nlimited to, trauma incidence reporting, system operation and patient\n\noutcome, and continuous quality improvement activities;\n\n7. Minimum requirements for periodic performance evaluation of\n\nthe system and its components through continuous quality improvement\n\nactivities;\n\n8. Minimum requirements for reviews of trauma patient\n\ntransfers;\n\n9. Requirements that hospitals with the capacity and capability\n\nto provide care not refuse to accept the transfer of a trauma\n\npatient from another facility solely because of the person's\n\ninability to pay for services or because of the person's age, sex,\n\nrace, religion or national origin;\n\n10. Requirements for transferring hospitals to enter into\n\nreciprocal agreements with receiving hospitals that specify that the\n\ntransferring hospital will accept the return transfer of trauma\n\npatients at such time as the hospital has the capability and\n\ncapacity to provide care; provided, however, such reciprocal\n\nagreements shall not incorporate financial provisions for transfers;\n\nand\n\n11. Minimum requirements for data collection for responses to\n\ntime-sensitive medical conditions including but not limited to\n\nstroke and ST-Elevated Myocardial Infarction (STEMI).
