There is hereby created in the State Treasury a revolving\n\nfund for the State Department of Health to be designated the \"Trauma\n\nCare Assistance Revolving Fund\". The fund shall be a continuing\n\nfund, not subject to fiscal year limitations, and shall consist of\n\nall monies received by the State Department of Health from monies\n\napportioned thereto for purposes of this section. All monies\n\naccruing to the credit of the fund are hereby appropriated and may\n\nbe budgeted and expended by the Department as follows:\n\n1. Ninety percent (90%) of such monies shall be used to\n\nreimburse recognized trauma facilities, licensed ambulance service\n\nproviders and physicians for uncompensated trauma care expenditures\n\nas documented in the statewide emergency medical services and trauma\n\nanalysis system developed pursuant to the provisions of Section 1-\n\n2511 of this title. In lieu of or in combination with reimbursement\n\nfor uncompensated care, monies from the fund may also be used to\n\nsupport readiness costs incurred by recognized trauma facilities\n\nassociated with ensuring a stable trauma care system with\n\navailability of twenty-four-hour physician services for the\n\nprovision of trauma care. Any monies used for the treatment of\n\nMedicaid-eligible patients that are subsequently used to establish\n\nfederal matching fund requirements shall also be reimbursed to\n\neligible trauma facilities, licensed ambulance service providers and\n\nphysicians; and\n\n2. Ten percent (10%) of such monies shall be used by the\n\nDepartment in the furtherance of its powers and duties set forth in\n\nthe Oklahoma Emergency Response Systems Development Act.\n\nB. Expenditures from the fund shall be made upon warrants\n\nissued by the State Treasurer against claims filed as prescribed by\n\nlaw with the Director of the Office of Management and Enterprise\n\nServices for approval and payment.\n\nC. The State Board of Health shall establish by rule a formula\n\nand procedure for the distribution of funds for uncompensated trauma\n\ncare and/or readiness costs that shall provide for the allocation of\n\nfunds to hospitals, ambulance service providers and physicians.\n\nD. Annually, monies accumulated in the fund may be transferred\n\nto the Oklahoma Health Care Authority, by order of the State\n\nCommissioner of Health, to maximize Medicaid reimbursement of trauma\n\ncare. The Oklahoma Health Care Authority shall use these funds with\n\nfederal matching funds to reimburse hospitals, ambulance service\n\nproviders and physicians for trauma care provided to severely\n\ninjured patients who are participants in Medicaid.\n\nE.
