Stat. tit. 63, § 63-1-293","heading":"Epinephrine auto-injector prescriptions – Training –","body":"Providing and administering auto-injectors – Immunity from\n\nliability.\n\nA. A licensed practitioner may prescribe epinephrine auto-\n\ninjectors in the name of an authorized entity or an authorized\n\nindividual for use in accordance with this section, and pharmacists\n\nand physicians may dispense epinephrine auto-injectors pursuant to a\n\nprescription issued in the name of an authorized entity or an\n\nauthorized individual; provided, however, such prescriptions shall\n\nonly be filled by pharmacists licensed in this state by the State\n\nBoard of Pharmacy.\n\nB. An authorized entity or an authorized individual may acquire\n\nand stock a supply of epinephrine auto-injectors pursuant to a\n\nprescription issued in accordance with this section. Such\n\nepinephrine auto-injectors shall be stored in a location readily\n\naccessible in an emergency and in accordance with the epinephrine\n\nauto-injector's instructions for use and any additional requirements\n\nthat may be established by the Board of Pharmacy. An authorized\n\nentity shall designate employees or agents who have completed the\n\ntraining required by Section 1-292 et seq. of this title to be\n\nresponsible for the storage, maintenance, and general oversight of\n\nepinephrine auto-injectors acquired by the authorized entity.\n\nC. An employee or agent of an authorized entity, an authorized\n\nindividual, or other individual, who has completed the training\n\nrequired by Section 1-292 et seq. of this title may, on the premises\n\nof or in connection with the authorized entity or authorized\n\nindividual, use epinephrine auto-injectors prescribed pursuant to\n\nSection 1-292 et seq. of this title to:\n\n1. Provide an epinephrine auto-injector to any individual who\n\nthe employee, agent or individual believes in good faith is\n\nexperiencing anaphylaxis for immediate self-administration,\n\nregardless of whether the individual has a prescription for an\n\nepinephrine auto-injector or has previously been diagnosed with an\n\nallergy; and\n\n2. Administer an epinephrine auto-injector to any individual\n\nwho the employee, agent or individual believes in good faith is\n\nexperiencing anaphylaxis, regardless of whether the individual has a\n\nprescription for an epinephrine auto-injector or has previously been\n\ndiagnosed with an allergy.\n\nD. An employee, agent or individual described in subsection C\n\nof this section must complete an anaphylaxis training program prior\n\nto providing or administering an epinephrine auto-injector pursuant\n\nto Section 1-292 et seq. of this title. Such training shall be\n\nconducted by a nationally recognized organization experienced in\n\ntraining laypersons in emergency health treatment or other entity or\n\nan individual approved by the Board of Pharmacy. The entity\n\nconducting training shall issue a certificate to each person who\n\nsuccessfully completes the anaphylaxis training program. Training\n\nmay be conducted online or in person and, at a minimum, shall cover:\n\n1. Techniques on how to recognize symptoms of severe allergic\n\nreactions, including anaphylaxis;\n\n2. Standards and procedures for the storage and administration\n\nof an epinephrine auto-injector; and\n\n3. Emergency follow-up procedures.\n\nE. An authorized entity or authorized individual that possesses\n\nand makes available epinephrine auto-injectors and employees,\n\nagents, authorized individuals, and other trained individuals; an\n\nindividual who uses an epinephrine auto-injector made available\n\npursuant to the provisions of Section 1-292 et seq. of this title; a\n\nlicensed practitioner that prescribes epinephrine auto-injectors to\n\nan authorized entity or authorized individual; and an individual or\n\nentity that conducts the training described in subsection D of this\n\nsection shall not be liable for any injuries or related damages that\n\nresult from the administration of, self-administration of or failure\n\nto administer an epinephrine auto-injector in accordance with this\ntitioner that prescribes epinephrine auto-injectors to\n\nan authorized entity or authorized individual; and an individual or\n\nentity that conducts the training described in subsection D of this\n\nsection shall not be liable for any injuries or related damages that\n\nresult from the administration of, self-administration of or failure\n\nto administer an epinephrine auto-injector in accordance with this\n\nsection that may constitute ordinary negligence.\n\n1. This immunity shall not apply to acts or omissions\n\nconstituting gross, willful or wanton negligence. The\n\nadministration of an epinephrine auto-injector in accordance with\n\nSection 1-292 et seq. of this title is not the practice of medicine.\n\nThe immunity from liability provided under this subsection is in\n\naddition to and not in lieu of that provided under the Good\n\nSamaritan Act.\n\n2. An entity located in this state shall not be liable for any\n\ninjuries or related damages that result from the provision or\n\nadministration of an epinephrine auto-injector by its employees or\n\nagents outside of this state if the entity or its employee or agent\n\nwould not have been liable for such injuries or related damages had\n\nthe provision or administration occurred within this state.\n\nF.
