A certificate of birth for each live birth which occurs in\n\nthis state shall be filed with the Commissioner of Health within\n\nseven (7) days after the birth.\n\nB. When a birth occurs in an institution, the person in charge\n\nof the institution or a designated representative shall obtain the\n\npersonal data, prepare the certificate and secure the signatures\n\nrequired by the certificate. The physician in attendance shall\n\ncertify to the facts of birth and provide the medical information\n\nrequired by the certificate within five (5) days after the birth.\n\nC. When a birth occurs outside an institution, the certificate\n\nshall be prepared and filed by one of the following in the indicated\n\norder of priority:\n\n1. The physician in attendance at or immediately after the\n\nbirth;\n\n2. Any other person in attendance at or immediately after the\n\nbirth; or\n\n3. The father, the mother or, in the absence or inability of\n\nthe father or mother, the person in charge of the premises where the\n\nbirth occurred and present at the birth.\n\nD. 1. If the mother was married at the time of birth, or\n\nmarried at any time during the three hundred (300) calendar days\n\nbefore the birth, the name of the husband shall be entered on the\n\ncertificate as the father of the child unless paternity has been\n\ndetermined otherwise by a court of competent jurisdiction or a\n\nhusband's denial of paternity form has been filed along with an\n\naffidavit acknowledging paternity, in which case the name of the\n\nfather as determined by the court or affidavit acknowledging\n\npaternity shall be entered. If there is a refusal to identify\n\npaternity on the birth certificate, the State Department of Health\n\nis authorized to register a birth certificate as such.\n\n2. If the mother was not married at the time of birth, nor\n\nmarried at any time during the three hundred (300) calendar days\n\nbefore the birth, the name of the father shall be entered on the\n\ncertificate of birth only if:\n\na. a determination of paternity has been made by an\n\nadministrative action through the Department of Human\n\nServices or a court of competent jurisdiction, in\n\nwhich case the name of the father shall be entered, or\n\nb. the mother and father have agreed as to the biological\n\npaternity of the child and signed an acknowledgment of\n\npaternity pursuant to Section 1-311.3 of this title,\n\nor substantially similar affidavit from another state\n\nand filed it with the Commissioner of Health.\n\nThis shall give the unmarried mother and biological father equal\n\nrights and obligations to the child. A child whose parentage has\n\nbeen determined as set forth shall be treated as a child of parents\n\nwho were married at the time of the birth.\n\nE. Either of the parents of the child shall sign the\n\ncertificate of live birth worksheet to attest to the accuracy of the\n\npersonal data entered thereon, in time to permit its filing within\n\nthe seven (7) days prescribed in this section.\n\nF. If the live birth results from a process in which the\n\ndelivering mother was carrying the child of another woman by way of\n\na prearranged legal contract, the original birth certificate shall\n\nbe filed with the personal information of the woman who delivered\n\nthe child. A new birth certificate will be placed on file once the\n\nDepartment receives both a court order and a completed form\n\nprescribed by the Department which identifies the various parties\n\nand documents the personal information of the intended parents\n\nnecessary to complete the new birth certificate.\n\nG.
