Stat. tit. 63, § 63-1-329.1","heading":"Cremation - Burial at sea - Bodies for pathologic","body":"study - Disposal permits.\n\nUntil a permit for disposal has been issued in accordance with\n\nthis section, no dead human body whose death occurred within the\n\nState of Oklahoma shall be cremated, buried at sea, or made\n\nunavailable for further pathologic study by other recognized means\n\nof destruction or dissolution of such remains.\n\nWhen the person legally responsible for disposition of a dead\n\nhuman body, whose death occurred or was pronounced within this\n\nstate, desires that the body be cremated, buried at sea, or made\n\nunavailable for further pathologic study by other recognized means\n\nof destruction or dissolution of such remains, that person shall\n\ncomplete an application-permit form for such procedure provided by\n\nthe Office of the Chief Medical Examiner. The Office of the Chief\n\nMedical Examiner, in accordance with Section 948.1 of this title,\n\nshall charge a fee for each cremation permit issued. The Medical\n\nExaminer shall be notified, as required in Section 938 of this\n\ntitle. He or she shall perform the required investigation and shall\n\nissue a valid death certificate as required by Section 947 of this\n\ntitle and execute the permit in accordance with rules established by\n\nthe Office of the Chief Medical Examiner. In order to be valid,\n\neach permit must contain an individual number assigned to the\n\nparticular permit by the Office of the Chief Medical Examiner. A\n\ncopy of the application-permit form and the original death\n\ncertificate shall be filed with the State Department of Health. The\n\noriginal application-permit form shall be filed by the funeral\n\ndirector with the Office of the Chief Medical Examiner. Such filing\n\nshall occur or be postmarked within forty-eight (48) hours of the\n\ndeath.\n\nIf death occurred or was pronounced outside the geographic\n\nlimits of the State of Oklahoma and the body is brought into this\n\nstate for such disposal, a transit permit or a permit for removal,\n\nissued in accordance with the laws and regulations in force where\n\nthe death occurred shall authorize the transportation of the body\n\ninto or through this state and shall be accepted in lieu of a\n\ncertificate of death as required above. A valid permit issued for\n\ndisposal of such body in accordance with the laws in the\n\njurisdiction where the body died or death was pronounced shall be\n\nauthority for cremation or burial at sea or to make the body\n\notherwise unavailable for further pathologic study by other\n\nrecognized means of destruction or dissolution of such remains.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"c86b942019157277cfcde66d2a1a4585bce77aeeb4d7d37549011416f7b46fc9","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-1-328","next":"us-ok/okla.-stat.-tit.-63-63-1-331"},"notice":"GroundRules: Original legal text.
