The State Board of Health may adopt such rules as it\n\ndeems necessary for the quarantine, isolation, impounding,\n\nimmunization and disposal of an animal to prevent and control any\n\nzoonotic disease. Rules of the Board shall consider, but not be\n\nlimited to:\n\na. prior rabies vaccinations,\n\nb. the degree of exposure to rabies,\n\nc. the history and prior behavior of the animal prior to\n\nexposure, and\n\nd. the willingness of the individual so exposed to submit\n\nto post-exposure antirabies immunization.\n\n2. The President of the State Board of Agriculture and the\n\nDirector of Wildlife Conservation shall be requested to make\n\nrecommendations on pertinent phases affecting their official duties\n\nbefore such rules are promulgated by the State Board of Health.\n\nB. 1. Whenever the State Commissioner of Health or a designee\n\ndetermines that any zoonotic disease exists in any area or that a\n\nperson has suffered an exposure to any such disease, the\n\nCommissioner shall have authority to issue an order declaring a\n\nquarantine, isolation, impounding, immunization or disposal of any\n\nanimal determined to be the source of such disease or exposure\n\naccording to rules promulgated by the State Board of Health. The\n\nCommissioner shall, assisted by the State Board of Agriculture and\n\nthe Director of Wildlife Conservation, cause such quarantine,\n\nisolation, impounding, immunization or disposal to be enforced.\n\n2. Public officers and employees acting within the scope of\n\ntheir authority in implementing or enforcing any such order, or\n\nrules promulgated for the control of zoonotic disease, shall not be\n\nheld liable for damages resulting from their official acts.\n\nC. It shall be unlawful for any person to willfully fail or\n\nrefuse to comply with a lawful order of the State Commissioner of\n\nHealth declaring a quarantine, isolation, impounding, immunization\n\nor disposal. Any person convicted of violating the provisions of\n\nthis subsection shall be guilty of a misdemeanor and may be punished\n\nby a fine of not more than One Hundred Dollars ($100.00), by\n\nimprisonment in the county jail for not more than thirty (30) days,\n\nor by both such fine and imprisonment.\n\nD.
