It shall be the duty of any physician, midwife, or other\n\nperson attendant upon the birth of a newborn infant to ensure\n\ntreatment of the eyes of the infant with a prophylactic ophthalmic\n\nagent as recommended by the Centers for Disease Control and\n\nPrevention as prophylaxis against ophthalmia neonatorum.\n\nB. Nothing in this section shall be construed to prohibit a\n\nparent or legal guardian of a newborn infant from refusing\n\nprophylactic treatment on religious grounds or when such person\n\ndeems that it is in the best interest of the child. If the parent\n\nor legal guardian of the newborn infant refuses the prophylactic\n\ntreatment, the health care provider shall document the refusal in\n\nthe medical file of the newborn infant.\n\nC.
