Stat. tit. 63, § 63-1-524","heading":"Prisoners - Examinations - Testing certain persons for","body":"sexually transmitted infection (STI) or human immunodeficiency virus\n\n(HIV) - Treatment - Quarantine.\n\nA. The keeper of any prison or penal institution in this state\n\nshall cause to be examined every person confined in such prison or\n\npenal institution, to determine whether such person is an infected\n\nperson.\n\nB. Any licensed physician may examine persons who are arrested\n\nby lawful warrant for prostitution, or other sex crimes not\n\nspecified in Section 1-524.1 of this title, for the purpose of\n\ndetermining if they are infected with a sexually transmitted\n\ninfection (STI) or a communicable disease including, but not limited\n\nto, the human immunodeficiency virus (HIV). For purposes of\n\nexpediting such examination, in counties with a population of\n\ngreater than four hundred thousand (400,000), the county sheriff or\n\nthe chief of police of any municipality with a population of greater\n\nthan two hundred thousand (200,000) that is located within such\n\ncounty and that has a municipal court of record shall notify the\n\ncity-county health department serving the county of any person who\n\nhas been arrested by county or city officers for prostitution. Any\n\nsuch examination shall be made subsequent to arrest and if the\n\nexamination is for the human immunodeficiency virus, upon order of\n\nthe court issued at the initial appearance of the arrested person.\n\nEvery person shall submit to the examination and shall permit\n\nspecimens to be taken for laboratory examinations. Such person may\n\nbe detained until the results of the examination are known. The\n\nexamination shall be made by a licensed physician. A determination\n\nas to whether or not the person is infected shall not be based on\n\nany prior examination. Any person found to be infected with a\n\nsexually transmitted infection (STI) shall be treated by the State\n\nCommissioner of Health or local health officer, or a physician of\n\nsuch person's own choice, until such person is noninfectious or\n\ndismissed by the Commissioner or local health officer or physician.\n\nIn the event a person infected with a sexually transmitted infection\n\n(STI) refuses or fails to submit to treatment, then such person may\n\nbe quarantined for the purpose of treatment, and a report thereof\n\nshall be made to the Commissioner.\n\nC.
