This act shall be known and may be cited as the \"Needlestick\n\nInjury Prevention Act\".\n\nB. For purposes of the Needlestick Injury Prevention Act:\n\n1. “Ambulance” means any ground, air or water vehicle approved\n\nby the State Commissioner of Health pursuant to the Oklahoma\n\nEmergency Response Systems Development Act and rules promulgated by\n\nthe State Board of Health pursuant thereto when used to provide\n\nappropriate on-scene and enroute stabilization and emergency medical\n\ncare;\n\n2. \"Bloodborne pathogens\" means pathogenic microorganisms that\n\nare present in human blood and that can cause disease in humans\n\nincluding, but not limited to, hepatitis B virus (HBV), hepatitis C\n\nvirus (HCV), and human immunodeficiency virus (HIV);\n\n3. \"Committee\" means the Needlestick Injury Prevention\n\nCommittee;\n\n4. “Department” means the State Department of Health;\n\n5. \"Engineered sharps injury protection\" means:\n\na. a physical attribute built into a needle device used\n\nfor withdrawing body fluids, accessing a vein or\n\nartery, or administering medications or other fluids,\n\nwhich effectively reduces the risk of an exposure\n\nincident through the use of mechanisms such as barrier\n\ncreation, blunting, encapsulation, withdrawal,\n\nretraction, or other effective mechanisms, or\n\nb. a physical attribute built into any other type of\n\nneedle device, or into a nonneedle sharp, which\n\neffectively reduces the risk of an exposure incident;\n\n6. “First responder” means an individual who performs emergency\n\nmedical services on scene in accordance with the Oklahoma Emergency\n\nResponse Systems Development Act and rules of the State Board of\n\nHealth promulgated thereto;\n\n7. “High exposure area” means an operating room, an ambulatory\n\nsurgical center, an emergency room, an intensive care unit, an\n\nambulance or an area or scene at which a first responder performs or\n\nprovides emergency medical services;\n\n8. \"Needleless systems\" means devices that do not utilize\n\nneedles for:\n\na. the withdrawal of body fluids after initial venous or\n\narterial access is established,\n\nb. the administration of medication or fluids, and\n\nc. any other procedure involving the potential for an\n\nexposure incident;\n\n9. \"Needlestick injury\" means the parenteral introduction into\n\nthe body of a health care worker of blood or other potentially\n\ninfectious material by a hollow-bore needle or sharp instrument,\n\nincluding, but not limited to, needles, lancets, scalpels, or\n\ncontaminated broken glass, during the performance of duties of such\n\nworker; and\n\n10. \"Sharps\" means any objects used or encountered in a health\n\ncare setting that can be reasonably anticipated to penetrate the\n\nskin or any other part of the body, and to result in an exposure\n\nincident, including, but not limited to, needle devices, scalpels,\n\nlancets, broken glass, broken capillary tubes, exposed ends of\n\ndental wires and dental knives, drills, and burs.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"226b7a1724bb3874e2ea853f99615bbecc0b385a800882092c41b449b44df04c","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-1-534.2","next":"us-ok/okla.-stat.-tit.-63-63-1-539.11"},"notice":"GroundRules: Original legal text.
