The State Commissioner of Health shall establish and\n\nmaintain an up-to-date tumor registry to ensure an accurate and\n\ncontinuing source of data concerning cancerous, precancerous and\n\ntumorous diseases. Such registry may include data necessary for\n\nepidemiological surveys and scientific research, and other data\n\nwhich is necessary and proper to further the recognition,\n\nprevention, control, treatment and cure of cancer, precancerous and\n\ntumorous diseases.\n\nB. The Commissioner shall require any hospital, clinic,\n\nlaboratory, pathologist, physician or dentist, or any facility which\n\nprovides diagnostic or treatment services for cancerous diseases and\n\nprecancerous conditions, to report any or all data and information\n\nnecessary for the purposes of this section which may include the\n\nfollowing:\n\n1. Patient name, address, age, race, sex, Social Security\n\nnumber and hospital identifier or other identifier;\n\n2. Patient's residential, family, environmental, occupational\n\nand medical histories; and\n\n3. Physician's name, diagnosis, stage of the disease, method of\n\ntreatment and the name and address of any facility providing\n\ntreatment.\n\nC. The provisions of subsection B of this section shall not\n\napply to ambulatory surgical centers, as defined by Section 2657 of\n\nthis title:\n\n1. Upon submission of a signed affidavit that the ambulatory\n\nsurgical center utilizes a sole source pathology laboratory to\n\nreport any or all data and information necessary for the purposes of\n\nthis section; or\n\n2. That are not certified by the Centers for Medicare and\n\nMedicaid Services.\n\nD. The Commissioner shall protect the identity of the patient\n\nand physician involved in any report required by this section, and\n\nmay not release their identity without written consent, except that:\n\n1. The Commissioner may grant any person involved in a\n\nlegitimate research activity access to confidential information\n\nobtained by the Department concerning individual patients if:\n\na. the research activity is determined to be in the\n\ninterest of the public health and welfare,\n\nb. the person conducting the research provides written\n\ninformation about the purpose of the research project,\n\nthe nature of the data to be collected and how the\n\nresearcher intends to analyze it, the records the\n\nresearcher wishes to review, and the safeguards the\n\nresearcher will take to protect the identity of the\n\npatients whose records the researcher will be\n\nreviewing,\n\nc. the proposed safeguards are adequate to protect the\n\nidentity of each patient whose records will be\n\nreviewed, and\n\nd. an agreement is executed between the Commissioner and\n\nthe researcher that specifies the researcher's use of\n\nthe records and that prohibits the publication or\n\nrelease of the names of individual cancer patients or\n\nany facts tending to lead to the identification of\n\nindividual cancer patients;\n\n2. Researchers may, with the approval of the Commissioner, use\n\nthe names of individual patients when requesting additional\n\ninformation for research purposes or soliciting an individual\n\npatient's participation in a research project. However, if a\n\nresearcher requests additional information or an individual\n\npatient's participation in a research project, the researcher must\n\nfirst obtain the written consent of the patient's attending\n\nphysician. If the consent of the patient's attending physician is\n\nobtained, the researcher must then obtain the individual cancer\n\npatient's written consent by having the patient complete a release\n\nof confidential medical information form;\n\n3. Data on patients may be shared with other registries,\n\nprivate or governmental, within or without the state, provided that\n\na reciprocal data-sharing agreement, approved by the Commissioner,\n\nis implemented with that registry. Such agreements must include\n\npatient identification confidentiality requirements; and\ny having the patient complete a release\n\nof confidential medical information form;\n\n3. Data on patients may be shared with other registries,\n\nprivate or governmental, within or without the state, provided that\n\na reciprocal data-sharing agreement, approved by the Commissioner,\n\nis implemented with that registry. Such agreements must include\n\npatient identification confidentiality requirements; and\n\n4. Provided further, that any confidential information released\n\nby the Commissioner under this section shall be deemed to be a\n\nconfidential communication within the meaning of the physician-\n\npatient and the psychotherapist-patient privilege.\n\nE. Nothing in this section shall be construed to compel any\n\nindividual to submit to any medical examination, treatment or\n\nsupervision of any kind; nor shall anyone providing information in\n\naccordance with this section be deemed to be, or held liable for,\n\ndivulging confidential information. An individual shall have the\n\nright to deny registration on religious grounds.\n\nF. The Commissioner may promulgate rules to carry out the\n\nprovisions of this section.\n\nG. Any person who, in violation of a written agreement to\n\nmaintain confidentiality, willfully discloses any information\n\nprovided pursuant to this section shall be denied further access to\n\nany confidential information maintained by the Department. That\n\nperson shall also be deemed guilty of a misdemeanor, and upon\n\nconviction thereof shall be punished by a fine of Two Hundred\n\nDollars ($200.00) or imprisonment in the county jail for not more\n\nthan thirty (30) days, or by both such fine and imprisonment.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"5d132a900488a80389af380d5600d7cde5bad4738907ee0362ccd9c6a872cfba","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-1-550.5","next":"us-ok/okla.-stat.-tit.-63-63-1-552"},"notice":"GroundRules: Original legal text.
