All health care facilities that perform mammography\n\nexaminations shall include in the summary of the mammography report,\n\nrequired by federal law to be provided to a patient, information\n\nthat identifies the patient's individual breast density\n\nclassification as dense or not dense. If the patient elects to\n\nreceive the summary of the mammography report by electronic mail and\n\nprovides an electronic mail address, the summary shall be sent by\n\nelectronic mail. If the facility determines that a patient has\n\nheterogeneously or extremely dense breast tissue, the summary of the\n\nmammography report shall include the following notice:\n\n\"Breast tissue can be either dense or not dense. Dense tissue\n\nmakes it harder to find breast cancer on a mammogram and also raises\n\nthe risk of developing breast cancer. Your breast tissue is dense.\n\nIn some people with dense tissue, other imaging tests in addition to\n\na mammogram may help find cancers. Talk to your health care\n\nprovider about breast density, risks for breast cancer, and your\n\nindividual situation.\"\n\nB. Patients who receive diagnostic or screening mammograms may\n\nbe directed to informative material about breast density. This\n\ninformative material may include the American College of Radiology's\n\nmost current brochure on the subject of breast density available on\n\nthe American College of Radiology's website. Patients and health\n\ncare providers can be further informed by material from the American\n\nCancer Society or Mammography Saves Lives organizations.\n\nC. Nothing in this section shall be deemed to create a duty of\n\ncare or other legal obligation beyond the duty to provide notice as\n\nset forth in subsection A of this section.
