Stat. tit. 63, § 63-1-702.1","heading":"Public trust hospital address transfer limits","body":"No public trust hospital license or main provider location under\n\na provider agreement with the Centers for Medicare and Medicaid\n\nServices (CMS), as provided for under 42 C.F.R., Sections 489.1\n\nthrough 489.18, shall be transferred from its current address to an\n\naddress greater than fifteen (15) miles away, if the public trust\n\nhospital is located in a community with a population of fewer than\n\nthirty thousand (30,000) residents, according to the latest Federal\n\nDecennial Census. If a public trust hospital facility announces a\n\nclosure, before the closure of the facility, a mediator shall be\n\nappointed. The municipality beneficiary of the public trust\n\nhospital shall also appoint a mediator. The two mediators shall\n\nappoint a mutually agreed-upon third mediator. The three mediators\n\nshall agree upon a sales price for the hospital, in accordance with\n\nappropriate due diligence and financial audits received from the\n\npublic trust hospital, if the hospital and the municipality cannot\n\nagree without mediation. The hospital shall be transferred to the\n\nbeneficiary municipality if the beneficiary municipality is willing\n\nto pay the agreed-upon purchase price set forth by the mediators and\n\nhas the appropriate staff identified to operate the hospital.\n\nIn the event the public trust hospital is sold to another\n\nentity, the trustees of the hospital shall certify that they have\n\nnot entered into any agreement, formal or informal, with the\n\nprospective owners of the hospital regarding any position, role, or\n\nemployment for themselves or their direct relatives, and they shall\n\nalso certify that they have not and will not receive any financial\n\nbenefit from the prospective owners, whether in-kind or otherwise.\n\nIn the event a public, third party, has been leasing the public\n\ntrust hospital and operating the public trust hospital under a\n\nlease, upon termination of that lease, the hospital CMS provider\n\nnumber shall revert back to the public trust hospital immediately\n\nupon lease termination, in accordance with the provisions of 42\n\nC.F.R., Section 489.18.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"f2cbc2de5a2c577dbd57157762720facf24500f48c1ddc68631b78a9a21174e9","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-1-702","next":"us-ok/okla.-stat.-tit.-63-63-1-702.2"},"notice":"GroundRules: Original legal text.
