The State Commissioner of Health shall issue licenses for\n\nthe operation of hospitals found to comply with the provisions of\n\nSection 1-701 et seq. of this title and rules and standards of the\n\nCommissioner.\n\nB. A hospital with an emergency department shall take the\n\nfollowing measures:\n\n1. Adopt and enforce policies and procedures to comply with the\n\nrequirements of the Emergency Medical Treatment and Labor Act, 42\n\nU.S.C., Section 1395dd (2012), even if the facility does not\n\nparticipate in the federal Medicare program;\n\n2. Post signs in the dedicated emergency department specifying\n\nthe rights of individuals with emergency medical conditions who come\n\nto the dedicated emergency department for health care services in\n\ncompliance with 42 CFR, Section 489.20(q), and indicate on the signs\n\nwhether the facility does not participate in Medicare, Medicaid or\n\nother federally sponsored health insurance such as Tricare; and\n\n3. Post the information required under paragraph 2 of this\n\nsubsection on the facility's Internet website.\n\nC. The Commissioner may suspend or revoke any such license on\n\nany of the following grounds:\n\n1. Violation of any of the provisions of Section 1-701 et seq.\n\nof this title, or rules or standards promulgated pursuant thereto;\n\n2. Permitting, aiding or abetting the commission of any illegal\n\nact in the licensed hospital or institution; or\n\n3. Conduct or practices deemed by the Commissioner to be\n\ndetrimental to the welfare of the patients of the hospital or\n\ninstitution.\n\nD. Upon notice of non-renewal and expiration of the opportunity\n\nto respond, a license shall be deemed to be surrendered. However,\n\nif a licensee has filed noticed with intent to renew the license\n\nwithin the time frame established by the State Department of Health,\n\nthe license shall not be deemed to be surrendered by the Department.\n\nE. If a license is revoked, a new application for license shall\n\nbe considered by the Commissioner on receipt of evidence that the\n\nconditions upon which revocation was based have been corrected. A\n\nnew license may then be granted after proper inspection has been\n\nmade and all provisions of Section 1-701 et seq. of this title and\n\nrules and standards of the Commissioner have been satisfied. The\n\napplication for a new license after revocation or surrender shall\n\nresult in a new license number from the Department.
