As used in this section:\n\n1. “Emergency opioid antagonist” means a drug including but not\n\nlimited to naloxone that blocks the effects of opioids and that is\n\napproved by the United States Food and Drug Administration for the\n\ntreatment of an opioid overdose; and\n\n2. “Health benefit plan” has the same meaning as provided by\n\nSection 6060.4 of Title 36 of the Oklahoma Statutes.\n\nB. A hospital shall distribute to a person who presents to an\n\nemergency department with symptoms of an opioid overdose, opioid use\n\ndisorder, or other adverse event related to opioid use, two doses of\n\nan emergency opioid antagonist upon discharge, unless:\n\n1. The treating practitioner determines in his or her clinical\n\nand professional judgment that distributing the emergency opioid\n\nantagonist is not appropriate or the practitioner has confirmed that\n\nthe patient already has at least two doses of an emergency opioid\n\nantagonist; or\n\n2. The hospital is not required to distribute the emergency\n\nopioid antagonist due to the conditions described in paragraph 2 of\n\nsubsection C of this section.\n\nC. 1. The provisions of subsection B of this section shall\n\napply without exception in cases where a patient is covered by the\n\nstate Medicaid program or by a health benefit plan.\n\n2. The provisions of subsection B of this section shall apply\n\nin cases where a patient is not covered by the state Medicaid\n\nprogram or by a health benefit plan only if the hospital receives a\n\nsupply of one or more emergency opioid antagonists from the\n\nDepartment of Mental Health and Substance Abuse Services under\n\nSection 1 of this act.\n\nD. To comply with the requirements of this section, a hospital\n\nmay, notwithstanding any other provision of state law, utilize any\n\nof the following individuals employed by or under contract with the\n\nhospital to distribute emergency opioid antagonists under this\n\nsection:\n\n1. Any health care provider licensed or certified in this state\n\nincluding, but not limited to, a licensed pharmacist; or\n\n2. Any mental health or substance abuse provider licensed or\n\ncertified in this state.\n\nE. 1. In cases where a patient to whom an opioid antagonist is\n\ndistributed under this section is covered under the state Medicaid\n\nprogram, the hospital may bill the state Medicaid program for the\n\nemergency opioid antagonist utilizing the appropriate billing codes\n\nestablished by the Oklahoma Health Care Authority. The state\n\nMedicaid program shall reimburse such claims in accordance with\n\napplicable law, rules, and contract terms. This billing shall be\n\nseparate from and in addition to the payment for the other services\n\nprovided during the hospital visit.\n\n2. In cases where a patient to whom an opioid antagonist is\n\ndistributed under this section is covered by a health benefit plan,\n\nthe hospital may bill the patient’s health benefit plan for the cost\n\nof the emergency opioid antagonist, and the health plan shall\n\nreimburse such claims.\n\nF. When a hospital distributes an emergency opioid antagonist,\n\nit shall provide:\n\n1. Directions for use; and\n\n2. Information and resources about medication for opioid use\n\ndisorder and harm reduction strategies and services which may be\n\navailable, such as substance use disorder treatment services and\n\nsubstance use disorder peer counselors.\n\nThis information shall be available in all languages relevant to\n\nthe communities that the hospital serves.\n\nG. This section does not prohibit a hospital from distributing\n\nan emergency opioid antagonist to a patient at no cost to the\n\npatient and at no cost to a third-party payor out of the hospital’s\n\nprepurchased supply.\n\nH. Nothing in this section prohibits or modifies a hospital’s\n\nability or responsibility to bill a patient’s health benefit plan or\n\nto provide financial assistance as required by state or federal law.\ns not prohibit a hospital from distributing\n\nan emergency opioid antagonist to a patient at no cost to the\n\npatient and at no cost to a third-party payor out of the hospital’s\n\nprepurchased supply.\n\nH. Nothing in this section prohibits or modifies a hospital’s\n\nability or responsibility to bill a patient’s health benefit plan or\n\nto provide financial assistance as required by state or federal law.\n\nI.
