This section shall be known and may be cited as the \"No\n\nPatient Left Alone Act\".\n\nB. Subject to the provisions of subsections D and E of this\n\nsection, each minor who is admitted to a hospital licensed pursuant\n\nto Section 1-702 of Title 63 of the Oklahoma Statutes has the right\n\nto have a parent, guardian or person standing in loco parentis who\n\nshall have the ability to be present while the minor patient is\n\nreceiving hospital care.\n\nC. Subject to the provisions of subsections D and E of this\n\nsection, each adult who is admitted to a hospital licensed pursuant\n\nto Section 1-702 of Title 63 of the Oklahoma Statutes has the right\n\nto designate a spouse, family member or caregiver who shall have the\n\nability to be physically present while the adult patient is\n\nreceiving hospital care.\n\nD. A hospital may establish visitation policies that limit or\n\nrestrict visitation when:\n\n1. The presence of visitors would be medically or\n\ntherapeutically contraindicated in the best clinical judgment of\n\nhealth care professionals;\n\n2. The presence of visitors would interfere with the care of or\n\nrights of any patient;\n\n3. Visitors are engaging in disruptive, threatening or violent\n\nbehavior toward any staff member, patient or other visitor; or\n\n4. Visitors are noncompliant with hospital policy.\n\nE. A hospital may require visitors to wear personal protective\n\nequipment, provided that any such required equipment shall be\n\nprovided by the hospital. A hospital may require visitors to comply\n\nwith reasonable safety protocols and rules of conduct. The hospital\n\nmay revoke visitation rights for failure to comply with this\n\nsection.\n\nF. Nothing in this section shall be construed to require a\n\nhospital to allow a visitor to enter an operating room, isolation\n\nroom, isolation unit, behavioral health setting or other typically\n\nrestricted area or to remain present during the administration of\n\nemergency care in critical situations. Nothing in this section\n\nshall be construed to require a hospital to allow a visitor access\n\nbeyond the rooms, units or wards in which the patient the visitor is\n\nvisiting is receiving care or beyond general common areas in the\n\nhospital.\n\nG. The rights specified in this section may not be terminated,\n\nsuspended or waived by the hospital, the State Department of Health\n\nor any governmental entity, notwithstanding declarations of\n\nemergency declared by the Governor or the Legislature. No hospital\n\nlicensed pursuant to Section 1-702 of Title 63 of the Oklahoma\n\nStatutes shall require a patient to waive the rights specified in\n\nthis section.\n\nH. Each hospital licensed pursuant to Section 1-702 of Title 63\n\nof the Oklahoma Statutes shall post on its website informational\n\nmaterials developed by the State Department of Health explaining the\n\nrights specified in this section. The State Department of Health\n\nshall develop such informational materials and make the materials\n\navailable to hospitals for this purpose.\n\nI. Unless expressly required by federal law or regulation, the\n\nState Department of Health or any other state agency shall not take\n\nany action against a hospital for:\n\n1. Giving a visitor individual access to a hospital-controlled\n\nproperty or location;\n\n2. Failing to protect or otherwise ensure the safety or comfort\n\nof a visitor given access to a hospital-controlled property or\n\nlocation;\n\n3. Failing to follow the guidelines of the Centers for Disease\n\nControl and Prevention or other federal guidelines that require or\n\nrecommend restricting visitor access; or\n\n4.
