Stat. tit. 63, § 63-1-707","heading":"Rules and standards – Oklahoma Hospital Advisory","body":"Council.\n\nA. The State Commissioner of Health, with the advice of the\n\nOklahoma Hospital Advisory Council, shall promulgate rules and\n\nstandards as the Commissioner deems to be in the public interest for\n\nhospitals, on the following:\n\n1. Construction plans and location, including fees not to\n\nexceed Two Thousand Dollars ($2,000.00) for submission or\n\nresubmission of architectural and building plans, and procedures to\n\nensure the timely review of such plans by the State Department of\n\nHealth. The assessed fee shall be used solely for the purposes of\n\nprocessing approval of construction plans and location by the State\n\nDepartment of Health;\n\n2. Physical plant and facilities;\n\n3. Fire protection and safety;\n\n4. Food service;\n\n5. Reports and records;\n\n6. Staffing and personal service;\n\n7. Surgical facilities and equipment;\n\n8. Maternity facilities and equipment;\n\n9. Control of communicable disease;\n\n10. Sanitation;\n\n11. Laboratory services;\n\n12. Nursing facilities and equipment; and\n\n13. Other items as may be deemed necessary to carry out the\n\npurposes of this article.\n\nB. 1. The State Commissioner of Health, with the advice of the\n\nOklahoma Hospital Advisory Council and the State Board of Pharmacy,\n\nshall promulgate rules and standards as the Commissioner deems to be\n\nin the public interest with respect to the storage and dispensing of\n\ndrugs and medications for hospital patients.\n\n2. The State Board of Pharmacy shall be empowered to inspect\n\ndrug facilities in licensed hospitals and shall report violations of\n\napplicable statutes and rules to the State Department of Health for\n\naction and reply.\n\nC. 1. The Commissioner shall appoint an Oklahoma Hospital\n\nAdvisory Council to advise the Department regarding hospital\n\noperations and to recommend actions to improve patient care.\n\n2. The Advisory Council shall have the duty and authority to:\n\na. review and approve in its advisory capacity rules and\n\nstandards for hospital licensure,\n\nb. evaluate, review and make recommendations regarding\n\nDepartment licensure activities; provided however, the\n\nAdvisory Council shall not make recommendations\n\nregarding scope of practice for any health care\n\nproviders or practitioners regulated pursuant to Title\n\n59 of the Oklahoma Statutes, and\n\nc. recommend and approve:\n\n(1) quality indicators and data submission\n\nrequirements for hospitals, and\n\n(2) the indicators and data to be used by the\n\nDepartment to monitor compliance with licensure\n\nrequirements.\n\nD. 1. The Advisory Council shall be composed of nine (9)\n\nmembers appointed by the Commissioner. The membership of the\n\nAdvisory Council shall be as follows:\n\na. two members shall be hospital administrators of\n\nlicensed hospitals,\n\nb. two members shall be licensed physicians or\n\npractitioners who have current privileges to provide\n\nservices in hospitals,\n\nc. two members shall be hospital employees, and\n\nd. three members shall be citizens representing the\n\npublic who:\n\n(1) are not hospital employees,\n\n(2) do not hold hospital staff appointments, and\nws:\n\na. two members shall be hospital administrators of\n\nlicensed hospitals,\n\nb. two members shall be licensed physicians or\n\npractitioners who have current privileges to provide\n\nservices in hospitals,\n\nc. two members shall be hospital employees, and\n\nd. three members shall be citizens representing the\n\npublic who:\n\n(1) are not hospital employees,\n\n(2) do not hold hospital staff appointments, and\n\n(3) are not members of hospital governing boards.\n\n2. a. Advisory Council members shall be appointed for three-\n\nyear terms except the initial terms after November 1,\n\n1999, of one hospital administrator, one licensed\n\nphysician or practitioner, one hospital employee, and\n\none public member shall be one (1) year. The initial\n\nterms after the effective date of this act of one\n\nhospital administrator, one licensed physician or\n\npractitioner, one hospital employee, and one public\n\nmember shall be two (2) years. The initial terms of\n\nall other members shall be three (3) years. After\n\ninitial appointments to the Council, members shall be\n\nappointed to three-year terms.\n\nb. Members of the Advisory Council may be removed by the\n\nCommissioner for cause.\n\nE. The Advisory Council shall meet on a quarterly basis and\n\nshall annually elect from among its members a chairperson.
