Except as provided by subsection C of this section, a\n\nhospital shall maintain and make publicly available a list of the\n\nstandard charges described by Section 3 of this act for each of at\n\nleast three hundred shoppable services provided by the hospital.\n\nThe hospital may select the shoppable services to be included in the\n\nlist, except that the list shall include:\n\n1. The seventy services specified as shoppable services by the\n\nCenters for Medicare and Medicaid Services; or\n\n2. If the hospital does not provide all of the shoppable\n\nservices described by paragraph 1 of this subsection, as many of\n\nthose shoppable services the hospital does provide.\n\nB. In selecting a shoppable service for purposes of inclusion\n\nin the list required under subsection A of this section, a hospital\n\nshall consider how frequently the hospital provides the service and\n\nthe hospital’s billing rate for that service.\n\nC. If a hospital does not provide three hundred shoppable\n\nservices, the hospital shall maintain a list of the total number of\n\nshoppable services that the hospital provides in a manner that\n\notherwise complies with the requirements of subsection A of this\n\nsection.\n\nD. The list required under subsection A or C of this section,\n\nas applicable, shall:\n\n1. Include:\n\na. a plain-language description of each shoppable service\n\nincluded on the list,\n\nb. the payor-specific negotiated charge that applies to\n\neach shoppable service included on the list and any\n\nancillary service, listed by the name of the third-\n\nparty payor and plan associated with the charge and\n\ndisplayed in a manner that clearly associates the\n\ncharge with the third-party payor and plan,\n\nc. the discounted cash price that applies to each\n\nshoppable service included on the list and any\n\nancillary service or, if the hospital does not offer a\n\ndiscounted cash price for one or more of the shoppable\n\nor ancillary services on the list, the gross charge\n\nfor the shoppable service or ancillary service, as\n\napplicable,\n\nd. the de-identified minimum negotiated charge that\n\napplies to each shoppable service included on the list\n\nand any ancillary service,\n\ne. the de-identified maximum negotiated charge that\n\napplies to each shoppable service included on the list\n\nand any ancillary service, and\n\nf. any code used by the hospital for purposes of\n\naccounting or billing for each shoppable service\n\nincluded on the list and any ancillary service,\n\nincluding the Current Procedural Terminology (CPT)\n\ncode, the Healthcare Common Procedure Coding System\n\n(HCPCS) code, the Diagnosis Related Group (DRG) code,\n\nthe National Drug Code (NDC), or other common\n\nidentifier; and\n\n2. If applicable:\n\na. state each location at which the hospital provides the\n\nshoppable service and whether the standard charges\n\nincluded in the list apply at that location to the\n\nprovision of that shoppable service in an inpatient\n\nsetting, an outpatient department setting, or in both\n\nof those settings, as applicable, and\n\nb. indicate if one or more of the shoppable services\n\nspecified by the Centers for Medicare and Medicaid\n\nServices is not provided by the hospital.\n\nE. The list required under subsection A or C of this section,\n\nas applicable, shall be:\n\n1. Displayed in the manner prescribed by subsection E of\n\nSection 3 of this act for the list required under that section;\n\n2. Available:\n\na. free of charge,\n\nb. without having to register or establish a user account\n\nor password, and\n\nc. without having to submit personal identifying\n\ninformation;\n\n3. Searchable by service description, billing code, and payor;\n\nand\n\n4. Updated in the manner prescribed by subsection G of Section\n\n3 of this act for the list required under that section.\n\nF. Notwithstanding any other provision of this section, a\n\nhospital is considered to meet the requirements of this section if\nt\n\nor password, and\n\nc. without having to submit personal identifying\n\ninformation;\n\n3. Searchable by service description, billing code, and payor;\n\nand\n\n4. Updated in the manner prescribed by subsection G of Section\n\n3 of this act for the list required under that section.\n\nF. Notwithstanding any other provision of this section, a\n\nhospital is considered to meet the requirements of this section if\n\nthe hospital maintains, as determined by the State Department of\n\nHealth, an Internet-based price estimator tool that:\n\n1. Provides a cost estimate for each shoppable service and any\n\nancillary service included on the list maintained by the hospital\n\nunder subsection A of this section;\n\n2. Allows a person to obtain an estimate of the amount the\n\nperson will be obligated to pay the hospital if the person elects to\n\nuse the hospital to provide the service; and\n\n3.
