Any person who knowingly or recklessly violates a provision\n\nof this act shall be liable for damages as provided in this section\n\nand may be enjoined from such acts in accordance with this section\n\nin an appropriate court.\n\nB. Any female upon whom an abortion has been performed or\n\ninduced, the father of the unborn child who was the subject of the\n\nabortion if the father was married to the woman who received the\n\nabortion at the time the abortion was performed or induced, or a\n\nmaternal grandparent of the unborn child may maintain an action\n\nagainst the person who performed or induced the abortion in knowing\n\nor reckless violation of this act for actual and punitive damages.\n\nAny female upon whom an abortion has been attempted to be performed\n\nor induced in knowing or reckless violation of this act may maintain\n\nan action against the person who attempted to perform or induce the\n\nabortion for actual and punitive damages.\n\nC. If a judgment is rendered in favor of the plaintiff in any\n\naction described in this section, the court shall also render\n\njudgment for a reasonable attorney fee in favor of the plaintiff\n\nagainst the defendant. If a judgment is rendered in favor of the\n\ndefendant and the court finds that the plaintiff's suit was\n\nfrivolous and brought in bad faith, the court shall also render\n\njudgment for a reasonable attorney fee in favor of the defendant\n\nagainst the plaintiff.\n\nD. A cause of action for injunctive relief against any person\n\nwho has knowingly or recklessly violated this act may be maintained\n\nby:\n\n1. The female upon whom an abortion was performed or induced or\n\nattempted to be performed or induced in violation of this act;\n\n2. Any person who is the spouse, parent, sibling or guardian\n\nof, or a current or former licensed health care provider of, the\n\nfemale upon whom an abortion has been performed or induced or\n\nattempted to be performed or induced in violation of this act;\n\n3. A district attorney with appropriate jurisdiction; or\n\n4. The Attorney General.\n\nThe injunction shall prevent the abortion provider from performing\n\nor inducing further abortions in violation of this act in the State\n\nof Oklahoma.\n\nE. Any person who knowingly or recklessly violates the terms of\n\nan injunction issued in accordance with this act shall be subject to\n\ncivil contempt, and shall be fined Ten Thousand Dollars ($10,000.00)\n\nfor the first violation, Fifty Thousand Dollars ($50,000.00) for the\n\nsecond violation, One Hundred Thousand Dollars ($100,000.00) for the\n\nthird violation and for each succeeding violation an amount in\n\nexcess of One Hundred Thousand Dollars ($100,000.00) sufficient to\n\ndeter future violations. The fines shall be the exclusive penalties\n\nfor such contempt. Each performance or induction or attempted\n\nperformance or induction of an abortion in violation of the terms of\n\nan injunction is a separate violation. These fines shall be\n\ncumulative. However, no fine may be assessed against the woman on\n\nwhom an abortion was performed or induced or was attempted to be\n\nperformed or induced.\n\nF. A physician who performed or induced an abortion or\n\nattempted to perform or induce an abortion in violation of this act\n\nshall be considered to have engaged in unprofessional conduct for\n\nwhich his or her license to practice medicine in the State of\n\nOklahoma may be suspended or revoked by the State Medical Board of\n\nLicensure and Supervision or the State Board of Osteophathic\n\nExaminers.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"22469168fb7dcce003667ded268001ba5c48e97ed683ca2bd57ede0915b505a1","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-1-729.2","next":"us-ok/okla.-stat.-tit.-63-63-1-729.4"},"notice":"GroundRules: Original legal text.
