Stat. tit. 63, § 63-1-737.8","heading":"Definitions","body":"For the purposes of the Oklahoma Unborn Child Protection from\n\nDismemberment Abortion Act:\n\n1. \"Abortion\" means the use or prescription of any instrument,\n\nmedicine, drug, or any other substance or device:\n\na. to purposely kill the unborn child of a woman known to\n\nbe pregnant, or\n\nb. to purposely terminate the pregnancy of a woman known\n\nto be pregnant, with a purpose other than:\n\n(1) after viability to produce a live birth and\n\npreserve the life and health of the child born\n\nalive, or\n\n(2) to remove a dead unborn child;\n\n2. \"Attempt to perform an abortion\" means to do or omit to do\n\nanything that, under the circumstances as the actor believes them to\n\nbe, is an act or omission constituting a substantial step in a\n\ncourse of conduct planned to culminate in the actor performing an\n\nabortion. Such substantial steps include, but are not limited to:\n\na. agreeing with an individual to perform an abortion on\n\nthat individual or on some other person, whether or\n\nnot the term \"abortion\" is used in the agreement, and\n\nwhether or not the agreement is contingent on another\n\nfactor such as receipt of payment or a determination\n\nof pregnancy, or\n\nb. scheduling or planning a time to perform an abortion\n\non an individual, whether or not the term \"abortion\"\n\nis used, and whether or not the performance is\n\ncontingent on another factor such as receipt of\n\npayment or a determination of pregnancy.\n\nThis definition shall not be construed to require that an abortion\n\nprocedure actually must be initiated for an attempt to occur;\n\n3. \"Dismemberment abortion\" means, with the purpose of causing\n\nthe death of an unborn child, purposely to dismember a living unborn\n\nchild and extract him or her one piece at a time from the uterus\n\nthrough use of clamps, grasping forceps, tongs, scissors or similar\n\ninstruments that, through the convergence of two rigid levers,\n\nslice, crush, and/or grasp a portion of the unborn child's body to\n\ncut or rip it off. This definition does not include an abortion\n\nwhich uses suction to dismember the body of the developing unborn\n\nchild by sucking fetal parts into a collection container;\n\n4. \"Physician\" means a person licensed to practice medicine and\n\nsurgery or osteopathic medicine and surgery, or otherwise legally\n\nauthorized to perform an abortion;\n\n5. \"Purposely\" means the following: A person acts purposely\n\nwith respect to a material element of an offense when:\n\na. if the element involves the nature of his or her\n\nconduct or a result thereof, it is his or her\n\nconscious objective to engage in conduct of that\n\nnature or to cause such a result, and\n\nb. if the element involves the attendant circumstances,\n\nhe or she is aware of the existence of such\n\ncircumstances or he or she believes or hopes that they\n\nexist;\n\n6. \"Serious health risk to the unborn child's mother\" means\n\nthat in reasonable medical judgment she has a condition that so\n\ncomplicates her medical condition that it necessitates the abortion\n\nof her pregnancy to avert her death or to avert serious risk of\n\nsubstantial and irreversible physical impairment of a major bodily\n\nfunction, not including psychological or emotional conditions.
