Notwithstanding any other provision of law, it shall be\n\nunlawful and deemed a Class D2 felony offense for any person to\n\npurposely perform or attempt to perform a dismemberment abortion and\n\nthereby kill an unborn child unless necessary to prevent serious\n\nhealth risk to the unborn child's mother.\n\nB. A person accused in any proceeding of unlawful conduct under\n\nsubsection A of this section may seek a hearing before the State\n\nBoard of Medical Licensure and Supervision on whether the\n\ndismemberment abortion was necessary to prevent serious health risk\n\nto the unborn child's mother. The Board's findings are admissible\n\non that issue at any trial in which such unlawful conduct is\n\nalleged. Upon a motion of the person accused, the court shall delay\n\nthe beginning of the trial for not more than thirty (30) days to\n\npermit such a hearing to take place.\n\nC. No woman upon whom an abortion is performed or attempted to\n\nbe performed shall be thereby liable for performing or attempting to\n\nperform a dismemberment abortion. No nurse, technician, secretary,\n\nreceptionist or other employee or agent who is not a physician but\n\nwho acts at the direction of a physician and no pharmacist or other\n\nindividual who is not a physician but who fills a prescription or\n\nprovides instruments or materials used in an abortion at the\n\ndirection of or to a physician shall be thereby liable for\n\nperforming or attempting to perform a dismemberment abortion.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"f022b78cf1bd7de64ee7afd1248e30937918e0faeb8cd28833b1179a78d6c051","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-1-737.8","next":"us-ok/okla.-stat.-tit.-63-63-1-738"},"notice":"GroundRules: Original legal text.
