Within ninety (90) days after the Unborn Child Pain\n\nAwareness/Prevention Act becomes law, the State Department of Health\n\nshall prepare a reporting form for physicians containing a reprint\n\nof the Unborn Child Pain Awareness/Prevention Act and listing:\n\n1. The number of females to whom the physician or an agent of\n\nthe physician provided the information described in subsection A of\n\nSection 1-738.8 of this title; of that number, the number provided\n\nby telephone and the number provided in person; and of each of those\n\nnumbers, the number provided in the capacity of a referring\n\nphysician and the number provided in the capacity of a physician who\n\nis to perform the abortion or agent of such a physician;\n\n2. The number of females who availed themselves of the\n\nopportunity to obtain a copy of the printed information described in\n\nSection 1-738.10 of this title other than on the website, and the\n\nnumber who did not; and of each of those numbers, the number who, to\n\nthe best of the information and belief of the reporting physician,\n\nwent on to obtain the abortion; and\n\n3. The number of abortions performed by the physician in which\n\ninformation otherwise required to be provided at least seventy-two\n\n(72) hours before the abortion was not so provided because an\n\nimmediate abortion was necessary to avert the death of the female,\n\nand the number of abortions in which such information was not so\n\nprovided because a delay would create serious risk of substantial\n\nand irreversible impairment of a major bodily function.\n\nB. The Department shall ensure that copies of the reporting\n\nforms described in subsection A of this section are provided:\n\n1. Within one hundred twenty (120) days after the Unborn Child\n\nPain Awareness/Prevention Act becomes law, to all physicians\n\nlicensed to practice in this state;\n\n2. To each physician who subsequently becomes newly licensed to\n\npractice in this state, at the same time as official notification to\n\nthat physician that the physician is so licensed; and\n\n3. By December 1 of each year, other than the calendar year in\n\nwhich forms are distributed in accordance with paragraph 1 of this\n\nsubsection, to all physicians licensed to practice in this state.\n\nC. By February 28 of each year following a calendar year in any\n\npart of which the Unborn Child Pain Awareness/Prevention Act was in\n\neffect, each physician who provided, or whose agent provided,\n\ninformation to one or more females in accordance with Section 1-\n\n738.8 of this title during the previous calendar year shall submit\n\nto the Department a copy of the form described in subsection A of\n\nthis section, with the requested data entered accurately and\n\ncompletely.\n\nD. Reports that are not submitted by the end of a grace period\n\nof thirty (30) days following the due date shall be subject to a\n\nlate fee of Five Hundred Dollars ($500.00) for each additional\n\nthirty-day period or portion of a thirty-day period the reports are\n\noverdue. Any physician required to report in accordance with this\n\nsection who has not submitted a report, or has submitted only an\n\nincomplete report, more than one (1) year following the due date\n\nmay, in an action brought by the State Board of Medical Licensure\n\nand Supervision, be directed by a court of competent jurisdiction to\n\nsubmit a complete report within a period stated by court order or be\n\nsubject to sanctions for civil contempt.\n\nE. By June 30 of each year, the Department shall issue a public\n\nreport providing statistics for the previous calendar year compiled\n\nfrom all of the reports covering that year submitted in accordance\n\nwith this section for each of the items listed in subsection A of\n\nthis section. Each such report shall also provide the statistics\n\nfor all previous calendar years, adjusted to reflect any additional\n\ninformation from late or corrected reports. The Department shall\nort providing statistics for the previous calendar year compiled\n\nfrom all of the reports covering that year submitted in accordance\n\nwith this section for each of the items listed in subsection A of\n\nthis section. Each such report shall also provide the statistics\n\nfor all previous calendar years, adjusted to reflect any additional\n\ninformation from late or corrected reports. The Department shall\n\ntake care to ensure that none of the information included in the\n\npublic reports could reasonably lead to the identification of any\n\nindividual providing or provided information in accordance with\n\nsubsection A or B of Section 1-738.8 of this title.\n\nF. The Department, by rule promulgated in accordance with the\n\nAdministrative Procedures Act, may alter the dates established by\n\nparagraph 3 of subsection B, subsection C, or subsection E of this\n\nsection or consolidate the forms or reports described in this\n\nsection with other forms or reports to achieve administrative\n\nconvenience or fiscal savings or to reduce the burden of reporting\n\nrequirements, so long as reporting forms are sent to all licensed\n\nphysicians in the state at least once every year and the report\n\ndescribed in subsection E of this section is issued at least once\n\nevery year.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"623db0ecfcc18e7812a560348e0ea9843f8fcb55597b0063f432f33691e7aaa3","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-1-738.12","next":"us-ok/okla.-stat.-tit.-63-63-1-738.14"},"notice":"GroundRules: Original legal text.
