Any person upon whom an abortion has been performed without\n\nthe Unborn Child Pain Awareness/Prevention Act having been complied\n\nwith, the father of the unborn child who was the subject of such an\n\nabortion, or the grandparent of such an unborn child may maintain an\n\naction against the person who performed the abortion in knowing or\n\nreckless violation of the Unborn Child Pain Awareness/Prevention Act\n\nfor actual and punitive damages. Any person upon whom an abortion\n\nhas been attempted without the Unborn Child Pain\n\nAwareness/Prevention Act having been complied with may maintain an\n\naction against the person who attempted to perform the abortion in\n\nknowing or reckless violation of the Unborn Child Pain\n\nAwareness/Prevention Act for actual and punitive damages.\n\nB.
