Stat. tit. 63, § 63-1-738.1A","heading":"Definitions","body":"As used in this section and Sections 1-738.2 through 1-738.5 of\n\nTitle 63 of the Oklahoma Statutes:\n\n1. \"Abortion\" means the term as defined in Section 1-730 of\n\nTitle 63 of the Oklahoma Statutes;\n\n2. \"Attempt to perform an abortion\" means an act, or an\n\nomission of a statutorily required act, that, under the\n\ncircumstances as the actor believes them to be, constitutes a\n\nsubstantial step in a course of conduct planned to culminate in the\n\nperformance of an abortion in this state in violation of this act;\n\n3. \"Board\" means the State Board of Medical Licensure and\n\nSupervision;\n\n4. \"Certified technician\" means a Registered Diagnostic Medical\n\nSonographer who is certified in obstetrics and gynecology by the\n\nAmerican Registry for Diagnostic Medical Sonography (ARDMS), or a\n\nnurse midwife or Advance Practice Nurse Practitioner in obstetrics\n\nwith certification in obstetrical ultrasonography;\n\n5. \"Medical emergency\" means the existence of any physical\n\ncondition, not including any emotional, psychological, or mental\n\ncondition, which a reasonably prudent physician, with knowledge of\n\nthe case and treatment possibilities with respect to the medical\n\nconditions involved, would determine necessitates the immediate\n\nabortion of the pregnancy of the female to avert her death or to\n\navert substantial and irreversible impairment of a major bodily\n\nfunction arising from continued pregnancy;\n\n6. \"Physician\" means a person licensed to practice medicine in\n\nthis state pursuant to Sections 495 and 633 of Title 59 of the\n\nOklahoma Statutes;\n\n7. \"Probable gestational age of the unborn child\" means what,\n\nin the judgment of the physician, will with reasonable probability\n\nbe the gestational age of the unborn child at the time the abortion\n\nis planned to be performed;\n\n8. \"Stable Internet website\" means a website that, to the\n\nextent reasonably practicable, is safeguarded from having its\n\ncontent altered other than by the State Board of Medical Licensure\n\nand Supervision;\n\n9. \"Unborn child\" means the term as is defined in Section 1-730\n\nof Title 63 of the Oklahoma Statutes; and\n\n10. \"Woman\" means a female human being whether or not she has\n\nreached the age of majority.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"51a6eb09dec0c7b9a3c67650f39f899e516833a7645759655d8fef18a5df1ae6","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-1-738.17","next":"us-ok/okla.-stat.-tit.-63-63-1-738.2"},"notice":"GroundRules: Original legal text.
