By February 1, 2008, the State Department of Health shall\n\nprepare and make available on its stable Internet website the form\n\ndescribed in subsection B of this section. A copy of this act shall\n\nbe posted on the website. Physicians performing abortions shall\n\ncomplete and electronically submit the required forms to the\n\nDepartment no later than April 1 for the previous calendar year.\n\nNothing in the report shall contain the name, address, or any other\n\nidentifying information of any patient.\n\nB. The form for physicians shall contain a listing for the\n\nfollowing information:\n\n1. The number of females to whom the physician, or an agent of\n\nthe physician, provided the information described in Section 1-738.2\n\nof Title 63 of the Oklahoma Statutes; of that number, the number\n\nprovided the information by telephone and the number provided the\n\ninformation in person; and of each of those numbers, the number\n\nprovided the information in the capacity of a referring physician\n\nand the number provided the information in the capacity of a\n\nphysician who is to perform the abortion; and of each of those\n\nnumbers, the number provided the information by the physician and\n\nthe number provided the information by an agent of the physician;\n\n2. The number of females who availed themselves of the\n\nopportunity to obtain a copy of the printed information described in\n\nSection 1-738.3 of Title 63 of the Oklahoma Statutes other than on\n\nthe website, and the number who did not; and of each of those\n\nnumbers, the number who, to the best of the information and belief\n\nof the reporting physician, went on to obtain the abortion; and\n\n3. The number of abortions performed by the physician in which\n\ninformation otherwise required to be provided at least seventy-two\n\n(72) hours before the abortion was not so provided because an\n\nimmediate abortion was necessary to avert the death of the female,\n\nand the number of abortions in which the information was not so\n\nprovided because a delay would cause substantial and irreversible\n\nimpairment of a major bodily function.\n\nC. The State Department of Health shall ensure that the\n\nreporting forms described in subsection B of this section are\n\nposted, on its stable Internet website, within one hundred twenty\n\n(120) days after the effective date of this act. The State\n\nDepartment of Health shall notify the following of the requirements\n\nof this act:\n\n1. By March 1, 2008, all physicians licensed to practice in\n\nthis state;\n\n2. Each physician who subsequently becomes newly licensed to\n\npractice in this state, at the same time as official notification to\n\nthat physician that the physician is so licensed; and\n\n3. By December 1 of each year, other than the calendar year in\n\nwhich forms are first made available to all physicians licensed to\n\npractice in this state.\n\nD. By February 28 of each year following a calendar year in any\n\npart of which this section was in effect, each physician who\n\nprovided, or whose agent provided, information to one or more\n\nfemales in accordance with Section 1-738.2 of Title 63 of the\n\nOklahoma Statutes during the previous calendar year shall\n\nelectronically submit to the State Department of Health the form\n\ndescribed in subsection B of this section, with the requested data\n\nentered accurately and completely.\n\nE. Reports that are not electronically submitted by the end of\n\na grace period of thirty (30) days following the due date shall be\n\nsubject to a late fee of Five Hundred Dollars ($500.00) for each\n\nadditional thirty-day period or portion of a thirty-day period the\n\nreports are overdue. Any physician required to report in accordance\n\nwith this section who has not completed and electronically submitted\n\na report, or has electronically submitted only an incomplete report,\n\nmore than one (1) year following the due date, may, in an action\nto a late fee of Five Hundred Dollars ($500.00) for each\n\nadditional thirty-day period or portion of a thirty-day period the\n\nreports are overdue. Any physician required to report in accordance\n\nwith this section who has not completed and electronically submitted\n\na report, or has electronically submitted only an incomplete report,\n\nmore than one (1) year following the due date, may, in an action\n\nbrought by the State Department of Health, be directed by a court of\n\ncompetent jurisdiction to electronically submit a complete report\n\nwithin a period stated by court order or be subject to sanctions for\n\ncivil contempt.\n\nF. By June 30 of each year, the State Department of Health\n\nshall prepare and make available on its stable Internet website a\n\npublic report providing statistics for the previous calendar year\n\ncompiled from all items listed in subsection B of this section.\n\nEach report shall also provide statistics for all previous calendar\n\nyears, adjusted to reflect any additional information from late or\n\ncorrected reports. The State Department of Health shall take care\n\nto ensure that none of the information included in the public\n\nreports could reasonably lead to the identification of any\n\nindividual providing or provided information in accordance with\n\nsubsection B of this section.\n\nG. The State Department of Health may promulgate rules in\n\naccordance with the Administrative Procedures Act to alter the dates\n\nestablished by this section or consolidate the form or report\n\ndescribed in this section with other forms or reports to achieve\n\nadministrative convenience, fiscal savings or to reduce the burden\n\nof reporting requirements, as long as reporting forms are made\n\navailable, on its stable Internet website to all licensed physicians\n\nin the state, and the report described in this section is issued at\n\nleast once every year.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"6d9abf8df6950d1d9c7e7b4a49636ec0f5062b3e4814126479ba6477a8183c4c","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-1-738.3","next":"us-ok/okla.-stat.-tit.-63-63-1-738.3d"},"notice":"GroundRules: Original legal text.
