Stat. tit. 63, § 63-1-738.3e","heading":"Violation of ultrasound requirement - Injunctive","body":"relief - Action for damages - License suspension.\n\nA. An abortion provider who knowingly violates a provision of\n\nSection 2 of this act shall be liable for damages as provided in\n\nthis section and may be enjoined from such acts in accordance with\n\nthis section in an appropriate court.\n\nB. A cause of action for injunctive relief against any person\n\nwho has knowingly violated a provision of Section 2 of this act may\n\nbe maintained by the woman upon whom an abortion was performed or\n\nattempted to be performed in violation of this act; any person who\n\nis the spouse, parent, sibling or guardian of, or a current or\n\nformer licensed health care provider of, the female upon whom an\n\nabortion has been performed or attempted to be performed in\n\nviolation of this act; by a district attorney with appropriate\n\njurisdiction; or by the Attorney General. The injunction shall\n\nprevent the abortion provider from performing further abortions in\n\nviolation of this act in the State of Oklahoma.\n\nC. Any person who knowingly violates the terms of an injunction\n\nissued in accordance with this section shall be subject to civil\n\ncontempt, and shall be fined Ten Thousand Dollars ($10,000.00) for\n\nthe first violation, Fifty Thousand Dollars ($50,000.00) for the\n\nsecond violation, One Hundred Thousand Dollars ($100,000.00) for the\n\nthird violation, and for each succeeding violation an amount in\n\nexcess of One Hundred Thousand Dollars ($100,000.00) that is\n\nsufficient to deter future violations. The fines shall be the\n\nexclusive penalties for such contempt. Each performance or\n\nattempted performance of an abortion in violation of the terms of an\n\ninjunction is a separate violation. These fines shall be\n\ncumulative. No fine shall be assessed against the woman on whom an\n\nabortion is performed or attempted.\n\nD. A pregnant woman upon whom an abortion has been performed in\n\nviolation of Section 2 of this act, or the parent or legal guardian\n\nof the woman if she is an unemancipated minor, as defined in Section\n\n1-740.1 of Title 63 of the Oklahoma Statutes, may commence a civil\n\naction against the abortion provider for any knowing or reckless\n\nviolation of this act for actual and punitive damages.\n\nE. An abortion provider who performed an abortion in violation\n\nof Section 2 of this act shall be considered to have engaged in\n\nunprofessional conduct for which the provider's certificate or\n\nlicense to provide health care services in this state may be\n\nsuspended or revoked by the State Board of Medical Licensure and\n\nSupervision or the State Board of Osteopathic Examiners.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"2f4cd4d42d5479905c0788e25022bdc58c538e8e4a4fd85ca574f2d8fa82185f","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-1-738.3d","next":"us-ok/okla.-stat.-tit.-63-63-1-738.3f"},"notice":"GroundRules: Original legal text.
