Stat. tit. 63, § 63-1-738.7","heading":"Definitions","body":"As used in the Unborn Child Pain Awareness/Prevention Act:\n\n1. \"Abortion\" means the use or prescription of any instrument,\n\nmedicine, drug, or any other substance or device intentionally to\n\nterminate the pregnancy of a female known to be pregnant with an\n\nintention other than to increase the probability of a live birth, to\n\npreserve the life or health of the child after live birth, to remove\n\nan ectopic pregnancy, or to remove a dead fetus who dies as the\n\nresult of a spontaneous miscarriage, accidental trauma or a criminal\n\nassault on the pregnant female or her unborn child;\n\n2. \"Attempt to perform an abortion\" means an act, or an\n\nomission of a statutorily required act that, under the circumstances\n\nas the actor believes them to be, constitutes a substantial step in\n\na course of conduct planned to culminate in the performance of an\n\nabortion in Oklahoma in violation of the Unborn Child Pain\n\nAwareness/Prevention Act;\n\n3. \"Unborn child\" means a member of the species homo sapiens\n\nfrom fertilization until birth;\n\n4. \"Medical emergency\" means the existence of any physical\n\ncondition, not including any emotional, psychological, or mental\n\ncondition, which a reasonably prudent physician, with knowledge of\n\nthe case and treatment possibilities with respect to the medical\n\nconditions involved, would determine necessitates the immediate\n\nabortion of the pregnancy of the female to avert her death or to\n\navert substantial and irreversible impairment of a major bodily\n\nfunction arising from continued pregnancy;\n\n5. \"Physician\" means a person licensed to practice medicine in\n\nthis state pursuant to Sections 495 and 633 of Title 59 of the\n\nOklahoma Statutes; and\n\n6. \"Probable gestational age\" means the gestational age of the\n\nunborn child at the time the abortion is planned to be performed, as\n\ndetermined by the physician using reasonable probability.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"4098b3f443eeb2be8119785085a54c72bed83826952db702b9cbc440e0371d1a","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-1-738.6","next":"us-ok/okla.-stat.-tit.-63-63-1-738.8"},"notice":"GroundRules: Original legal text.
