Beginning in 2013, by June 1 of each year, the Department\n\nshall issue, on its stable Internet website, a public Annual\n\nAbortion Report providing statistics for the previous calendar year\n\ncompiled from all of the reports covering that year submitted in\n\naccordance with the Statistical Abortion Reporting Act.\n\nB. The Department's public report shall also provide statistics\n\nfor all previous calendar years for which abortion-reporting\n\nrequirements have been in effect, adjusted to reflect any additional\n\ninformation from late or corrected reports.\n\nC. The Annual Abortion Report shall include, but not be limited\n\nto, the following information:\n\n1. The number of induced abortions performed in the previous\n\ncalendar year, broken down by month and county in which the abortion\n\nwas performed;\n\n2. The number of abortions classified by:\n\na. the state or foreign country of residence of the\n\nmother,\n\nb. the age, marital status, and race of the mother, and\n\nc. the number of years of education of the mother;\n\n3. The number of abortions classified by:\n\na. the number of previous pregnancies of the mother,\n\nb. previous live births to the mother,\n\nc. previous miscarriages, and\n\nd. previous induced abortions;\n\n4. The number of abortions by week of gestational age;\n\n5. The number of abortions performed by each reported method;\n\n6. The number of abortions resulting in an infant born alive;\n\nof these, the number of cases in which life-sustaining measures were\n\ntaken; and a statistical summary of the length of survival of such\n\ninfants;\n\n7. The number of cases in which anesthesia was administered to\n\nthe mother and the number of each type of anesthesia;\n\n8. The number of cases in which anesthesia was administered to\n\nthe unborn child, and the number of each type of anesthesia and of\n\neach method of administration;\n\n9. The number of each reported method of fetal disposal;\n\n10. The reasons reported for the abortions, and the number of\n\ntimes each reported reason was cited;\n\n11. The number of abortions paid for by:\n\na. private insurance,\n\nb. public health plan,\n\nc. Medicaid,\n\nd. private pay, or\n\ne. other;\n\n12. The number of abortions in which medical health insurance\n\ncoverage was under:\n\na. a fee-for-service insurance company,\n\nb. a managed care company, or\n\nc. other;\n\n13. A statistical summary of the fees collected;\n\n14. Specialty area of medicine of the physician;\n\n15. The number of abortions in which ultrasound equipment was\n\nused before, during, or after the abortion, and the number of times\n\nvaginal ultrasound, abdominal ultrasound, or both were used in each\n\nof the three circumstances;\n\n16. The number of abortions before which an ultrasound was\n\nperformed by:\n\na. the physician performing the abortion,\n\nb. a physician other than the physician performing the\n\nabortion, or\n\nc. other;\n\n17. The number of abortions resulting in reported\n\ncomplications, and of those, how many were reported by the physician\n\nwho performed the abortion, and how many were reported by another\n\nphysician, the types of reported complications, and the number of\n\neach type based on data which shall be compiled and transmitted to\n\nthe State Department of Health by the State Board of Medical\n\nLicensure and Supervision and the State Board of Osteopathic\n\nExaminers;\n\n18. The number of abortions resulting in the reported death of\n\nthe mother;\n\n19. The number of females to whom the physician provided the\n\ninformation in subparagraph a of paragraph 1 of subsection B of\n\nSection 1-738.2 of this title; of that number, the number provided\n\nby telephone and the number provided in person; and of each of those\n\nnumbers, the number provided in the capacity of a referring\n\nphysician and the number provided in the capacity of a physician who\n\nis to perform the abortion;\n\nh a of paragraph 1 of subsection B of\n\nSection 1-738.2 of this title; of that number, the number provided\n\nby telephone and the number provided in person; and of each of those\n\nnumbers, the number provided in the capacity of a referring\n\nphysician and the number provided in the capacity of a physician who\n\nis to perform the abortion;\n\n20. The number of females to whom physicians or agents of\n\nphysicians provided the information in paragraph 2 of subsection B\n\nof Section 1-738.2 of this title; of that number, the number\n\nprovided by telephone and the number provided in person; of each of\n\nthose numbers, the number provided in the capacity of a referring\n\nphysician and the number provided in the capacity of a physician who\n\nis to perform the abortion; and of each of those numbers, the number\n\nprovided by the physician and the number provided by an agent of the\n\nphysician;\n\n21. The number of females who availed themselves of the\n\nopportunity to have a copy of the printed information described in\n\nSection 1-738.3 of this title mailed to them; and of that number,\n\nthe number who, based on the submitted reports, did and did not\n\nobtain an abortion;\n\n22. The number of abortions performed by the physician in which\n\ninformation otherwise required to be provided at least seventy-two\n\n(72) hours before the abortion was not so provided because an\n\nimmediate abortion was necessary to avert the death of the female,\n\nand the number of abortions in which such information was not so\n\nprovided because a delay would create serious risk of substantial\n\nand irreversible impairment of a major bodily function;\n\n23. The number of females to whom physicians or their agents\n\nprovided the information described in subsection A of Section 1-\n\n738.8 of this title; of that number:\n\na. the number provided by telephone and the number\n\nprovided in person; and of each of those numbers, the\n\nnumber provided in the capacity of a referring\n\nphysician and the number provided in the capacity of a\n\nphysician who is to perform the abortion, or by the\n\nagent of such physician, and\n\nb. the number of females who availed themselves of the\n\nopportunity to be given or mailed the materials\n\ndescribed in Section 1-738.10 of this title, and the\n\nnumber who did not; and of each of those numbers, the\n\nnumber who, to the best of the information and belief\n\nof the reporting physician, went on to obtain the\n\nabortion;\n\n24. The number of females to whom the information described in\n\nsubsection A of Section 1-738.8 of this title would have had to be\n\nprovided but for a medical emergency determination; of that number,\n\nthe number for whom an immediate abortion was necessary to avert the\n\ndeath of the female, and the number for whom a delay would have\n\ncreated serious risk of substantial and irreversible impairment of a\n\nmajor bodily function;\n\n25. The number of abortions performed within the scope of\n\nemployment of Oklahoma state employees and employees of an agency or\n\npolitical subdivision of the state, the number of abortions\n\nperformed with the use of public institutions, facilities,\n\nequipment, or other physical assets owned, leased, or controlled by\n\nthis state, its agencies, or political subdivisions, and for each\n\ncategory:\n\na. the number of abortions reported as necessary to save\n\nthe life of the mother, the life-endangering\n\nconditions identified, and the number of each such\n\ncondition reported,\n\nb. the number of abortions reported from pregnancies\n\nresulting from forcible rape, the number of such rapes\n\nreported to law enforcement authorities, general\n\ncategories of law enforcement authorities to whom\n\nreports were made and the number made to each\n\ncategory, and a statistical summary of the length of\n\ntime between the dates of reporting to law enforcement\n\nauthorities and the dates of the abortions, and\nf abortions reported from pregnancies\n\nresulting from forcible rape, the number of such rapes\n\nreported to law enforcement authorities, general\n\ncategories of law enforcement authorities to whom\n\nreports were made and the number made to each\n\ncategory, and a statistical summary of the length of\n\ntime between the dates of reporting to law enforcement\n\nauthorities and the dates of the abortions, and\n\nc. the number of abortions reported from pregnancies\n\nresulting from incest committed against a minor, the\n\nnumber of perpetrators of incest in such cases\n\nreported to law enforcement authorities, general\n\ncategories of law enforcement authorities to whom\n\nreports were made and the number made to each\n\ncategory, and a statistical summary of the length of\n\ntime between the dates of reporting to law enforcement\n\nauthorities and the dates of the abortions;\n\n26. The number of females to a parent of whom the physician\n\nprovided notice as required by Section 1-740.2 of this title; of\n\nthat number, the number provided personally as described in that\n\nsection, and the number provided by mail as described in that\n\nsection, and of each of those numbers, the number of females who, to\n\nthe best of the information and belief of the reporting physician,\n\nwent on to obtain the abortion;\n\n27. The number of females upon whom the physician performed an\n\nabortion without the notice to or consent of the parent of the minor\n\nrequired by Section 1-740.2 of this title; of that number, the\n\nnumber who were emancipated minors and the number who suffered from\n\na medical emergency, and of the latter, the number of cases in which\n\na parent was notified subsequently and the number of cases in which\n\na judicial waiver was obtained. In the case of medical emergencies\n\nin which a parent was informed subsequently, a statistical summary\n\nof the period of time elapsed before notification;\n\n28. The number of abortions performed after receiving judicial\n\nauthorization to do so without parental notice and consent;\n\n29. The number of abortions performed on minors after judicial\n\nauthorizations were granted because of a finding that the minor girl\n\nwas mature and capable of giving informed consent;\n\n30. The number of abortions performed on minors after judicial\n\nauthorizations were granted because of a finding that the\n\nperformance of the abortion without parental notification and\n\nconsent was in the best interest of the minor;\n\n31. The number of abortions performed after which the remains\n\nof the fetus after the abortion were examined to ensure that all\n\nsuch remains were evacuated from the mother's body;\n\n32. The number of male children aborted and female children\n\naborted, as determined from the examination of fetal remains after\n\nabortion;\n\n33. The number of male children aborted and female children\n\naborted, as determined by any method other than those reported in\n\nparagraph 32 of this subsection;\n\n34. The number of instances in which the mother was informed\n\nprior to the abortion that the child to be aborted was a female;\n\n35. The number of abortions performed without surgery but\n\nrather as the result of the administration of chemicals;\n\n36. The number of abortions performed as reported in paragraph\n\n35 of this subsection, in which the physician was present in the\n\nsame room as the woman to whom the chemicals were administered at\n\nthe time any such chemicals were first administered;\n\n37. The number of abortions performed for each hospital at\n\nwhich the abortionist had hospital privileges at the time of the\n\nabortion;\n\n38. The number of abortions performed at which ultrasound\n\nequipment was used before the abortion;\n\n39. The number of abortions reported in paragraph 38 of this\n\nsubsection, during which the mother was under the effect of\n\nanesthesia at the time of the ultrasound;\n\n40. The number of abortions performed at which ultrasound\n\nequipment was used during the abortion;\neges at the time of the\n\nabortion;\n\n38. The number of abortions performed at which ultrasound\n\nequipment was used before the abortion;\n\n39. The number of abortions reported in paragraph 38 of this\n\nsubsection, during which the mother was under the effect of\n\nanesthesia at the time of the ultrasound;\n\n40. The number of abortions performed at which ultrasound\n\nequipment was used during the abortion;\n\n41. The number of abortions reported in paragraph 40 of this\n\nsubsection, during which the mother was under the effect of\n\nanesthesia at the time of the ultrasound;\n\n42. The number of abortions performed at which ultrasound\n\nequipment was used after the abortion;\n\n43. The number of abortions reported in paragraph 42 of this\n\nsubsection, during which the mother was under the effect of\n\nanesthesia at the time of the ultrasound;\n\n44. The mean gestational age of the fetus at the time of the\n\nabortion, as determined by ultrasounds reported;\n\n45. The number of abortions for which no determination of\n\nprobable postfertilization age was made as required by Section 1-\n\n745.5 of this title; and\n\n46. The number of abortions in which the pregnant woman was\n\ntold that it may be possible to make the embryonic or fetal\n\nheartbeat of the unborn child audible for the pregnant woman to\n\nhear; the number of abortions in which the pregnant woman was asked\n\nif she would like to hear the heartbeat; and the number of abortions\n\nin which the embryonic or fetal heartbeat of the unborn child was\n\nmade audible for the pregnant woman to hear, using a Doppler fetal\n\nheart rate monitor.\n\nD. Beginning in 2013, by June 1 of each year, the State\n\nDepartment of Health shall post, on its stable Internet website, a\n\npublic Annual Judicial Bypass of Abortion Parental Consent Summary\n\nReport providing statistics which shall be compiled and supplied to\n\nthe Department by the Administrative Office of the Courts giving the\n\ntotal number of petitions or motions filed under Section 1-740.3 of\n\nthis title and of that number, the number in which:\n\n1. The court appointed a guardian ad litem;\n\n2. The court appointed counsel;\n\n3. The judge issued an order authorizing an abortion without\n\nparental notification or consent, and of those:\n\na. the number authorized due to a determination by the\n\njudge that the minor was mature and capable of giving\n\nconsent to the proposed abortion, and\n\nb. the number authorized due to a determination by the\n\njudge that an abortion was in the best interest of the\n\nminor; and\n\n4. The judge denied such an order, and of this, the number of:\n\na. denials from which an appeal was filed,\n\nb. the appeals that resulted in the denial being\n\naffirmed, and\n\nc. appeals that resulted in reversals of the denials.\n\nE. Each Annual Judicial Bypass of Abortion Parental Consent\n\nSummary Report shall also provide the statistics for all previous\n\ncalendar years for which the public statistical report was required\n\nto be issued, adjusted to reflect any additional information from\n\nlate or corrected reports.\n\nF. The Department's public reports shall not contain the name,\n\naddress, hometown, county of residence, or any other identifying\n\ninformation of any individual female, and shall take care to ensure\n\nthat none of the information included in its public reports could\n\nreasonably lead to the identification of any individual female about\n\nwhom information is reported in accordance with the Statistical\n\nAbortion Reporting Act or of any physician providing information in\n\naccordance with the Statistical Abortion Reporting Act.
