A form created by the State Department of Health shall be\n\nused by physicians to obtain the consent required prior to\n\nperforming an abortion on a minor who is not emancipated.\n\nB. A form is not valid, and therefore consent is not\n\nsufficient, unless:\n\n1. A parent or legal guardian initials each page of the form,\n\nindicating that he or she has read and understands the information\n\nincluded on that page;\n\n2. A parent or legal guardian signs the last page of the form\n\nin front of a person who is a notary public;\n\n3. The minor initials each list of risks and hazards listed in\n\nsubsection C of this section;\n\n4. The minor signs a consent statement described in subsection\n\nC of this section; and\n\n5. The physician signs the declaration described in subsection\n\nC of this section.\n\nC. The form shall include, but not be limited to, the\n\nfollowing:\n\n1. A description of the minor's rights, including her right to\n\ninformed consent;\n\n2. A description of the parent or legal guardian's rights\n\npursuant to Oklahoma law;\n\n3. A detailed description of the surgical and medical\n\nprocedures that are planned to be performed on the minor;\n\n4. A detailed list of the risks and hazards related to the\n\nsurgical and medical procedures planned for the minor, including but\n\nnot limited to:\n\na. risks and hazards that may occur in connection with\n\nany surgical, medical, or diagnostic procedure,\n\nincluding but not limited to infection, blood clots in\n\nveins and lungs, hemorrhage, allergic reactions, and\n\ndeath,\n\nb. risks and hazards that may occur with surgical\n\nabortion, including but not limited to hemorrhage,\n\nuterine perforation, sterility, injuries to the bowel\n\nand bladder, hysterectomy as a result of complication\n\nor injury during the procedure, and failure to remove\n\nall products of conception that may result in an\n\nadditional procedure,\n\nc. risks and hazards that may occur with a medical or\n\nnonsurgical abortion, including but not limited to\n\nhemorrhage, failure to remove all products of\n\nconception that may result in an additional procedure,\n\nsterility, and possible continuation of pregnancy, and\n\nd. risks and hazards of the particular procedure planned\n\nfor the minor, including but not limited to cramping\n\nof the uterus, pelvic pain, infection of the uterus,\n\ntubes, and ovaries, cervical laceration, incompetent\n\ncervix, and emergency treatment for any of the above\n\nnamed complications;\n\n5. A description of additional information that must be\n\nprovided by the physician to the minor pursuant to the provisions of\n\nSection 1-730 et seq. of this title;\n\n6. A consent statement which must be signed by the minor. The\n\nconsent statement must include, but not be limited to, the following\n\nrequirements, which must each be individually initialed by the\n\nminor:\n\na. that the minor understands that the doctor is going to\n\nperform an abortion on her which will end her\n\npregnancy and result in the death of her unborn child,\n\nb. that the minor is not being forced to have an abortion\n\nand that she has the choice not to have the abortion\n\nand may withdraw consent prior to the abortion,\n\nc. that the minor gives permission for the procedure,\n\nd. that the minor understands that there are risks and\n\nhazards that could affect the minor if she has the\n\nsurgical or medical procedures planned for her,\n\ne. that the minor has been given the opportunity to ask\n\nquestions about her condition, alternative forms of\n\ntreatment, risks of not receiving treatment, the\n\nprocedures to be used, and the risks and hazards\n\ninvolved,\n\nf. that the minor has been given information required by\n\nSection 1-730 et seq. of this title, and\n\ng. that the minor has sufficient information to give\n\ninformed consent;\n\n7. A physician declaration, which must be signed by the\n\nphysician, stating that the physician or his or her assistant has\nent, risks of not receiving treatment, the\n\nprocedures to be used, and the risks and hazards\n\ninvolved,\n\nf. that the minor has been given information required by\n\nSection 1-730 et seq. of this title, and\n\ng. that the minor has sufficient information to give\n\ninformed consent;\n\n7. A physician declaration, which must be signed by the\n\nphysician, stating that the physician or his or her assistant has\n\nexplained the procedure and the contents of this form to the minor\n\nand her parent or legal guardian, as required, and has answered all\n\nquestions. Further, to the best of the physician's knowledge, the\n\npatient and her parent or legal guardian have been adequately\n\ninformed and have consented to the procedure;\n\n8. A parental consent statement stating that the signing parent\n\nor legal guardian:\n\na. understands that the doctor signing the physician\n\ndeclaration is going to perform an abortion on the\n\nminor which will end her pregnancy and result in the\n\ndeath of her unborn child,\n\nb. that the parent or legal guardian had the opportunity\n\nto read this form or have it read to him or her and\n\nhas initialed each page,\n\nc. that the parent or legal guardian had the opportunity\n\nto ask questions to the physician or the physician's\n\nassistant about the information in this form and the\n\nsurgical and medical procedures to be performed on the\n\nminor,\n\nd. that the parent or legal guardian believes he or she\n\nhas sufficient information to give informed consent,\n\nand\n\ne. that by the parent or legal guardian's signature, the\n\nparent or legal guardian affirms that he or she is the\n\nminor's parent or legal guardian;\n\n9. A page for the parent or legal guardian's signature that\n\nmust be notarized by a notary public; and\n\n10.
