Except in the case of a medical emergency, a physician may\n\nnot perform an abortion on a pregnant female unless the physician\n\nhas:\n\n1. Obtained proof of age demonstrating that the female is not a\n\nminor;\n\n2. Obtained proof that the female, although a minor, is\n\nemancipated; or\n\n3. Complied with Section 1-740.3 of this title.\n\nB. No abortion shall be performed upon an unemancipated minor\n\nor upon a female for whom a guardian has been appointed pursuant to\n\nSection 1-113 of Title 30 of the Oklahoma Statutes because of a\n\nfinding of incompetency, except in a medical emergency or where a\n\njudicial waiver was obtained pursuant to Section 1-740.3 of this\n\ntitle, until at least forty-eight (48) hours after the request for\n\nwritten informed consent for the pending abortion has been delivered\n\nin the manner specified in this subsection and the attending\n\nphysician has secured proof of identification and the written\n\ninformed consent of one parent.\n\n1. The request for written informed consent of one parent shall\n\nbe addressed to the parent at the usual place of abode of the parent\n\nand delivered personally to the parent by the physician or an agent.\n\n2. In lieu of the delivery required by paragraph 1 of this\n\nsubsection, the request for written informed consent of one parent\n\nshall be made by certified mail addressed to the parent at the usual\n\nplace of abode of the parent with return-receipt requested and\n\nrestricted delivery to the addressee, which means a postal employee\n\ncan only deliver the mail to the authorized addressee. Time of\n\ndelivery shall be deemed to occur at 12 noon on the third day on\n\nwhich regular mail delivery takes place, subsequent to mailing. The\n\ninformation concerning the address of the parent shall be that which\n\na reasonable and prudent person, under similar circumstances, would\n\nhave relied upon as sufficient evidence that the parent resides at\n\nthat address.\n\n3. a. The parent who provides consent shall provide to the\n\nphysician a copy of a government-issued proof of\n\nidentification and written documentation that\n\nestablishes that he or she is the lawful parent of the\n\npregnant female. The parent shall certify in a\n\nsigned, dated, notarized statement, initialed on each\n\npage, that he or she consents to the abortion. The\n\nsigned, dated, and notarized statement shall include:\n\n\"I certify that I, (insert name of parent), am the\n\nparent of (insert name of minor daughter) and give\n\nconsent for (insert name of physician) to perform an\n\nabortion on my daughter. I understand that any person\n\nwho knowingly makes a fraudulent statement in this\n\nregard commits a felony.\"\n\nb. The physician shall keep a copy of the proof of\n\nidentification of the parent and the certified\n\nstatement in the medical file of the minor for five\nam the\n\nparent of (insert name of minor daughter) and give\n\nconsent for (insert name of physician) to perform an\n\nabortion on my daughter. I understand that any person\n\nwho knowingly makes a fraudulent statement in this\n\nregard commits a felony.\"\n\nb. The physician shall keep a copy of the proof of\n\nidentification of the parent and the certified\n\nstatement in the medical file of the minor for five\n\n(5) years past the majority of the minor, but in no\n\nevent less than seven (7) years.\n\nc. A physician receiving parental consent under this\n\nsection shall execute for inclusion in the medical\n\nrecord of the minor an affidavit stating: \"I, (insert\n\nname of physician), certify that according to my best\n\ninformation and belief, a reasonable person under\n\nsimilar circumstances would rely on the information\n\npresented by both the minor and her parent as\n\nsufficient evidence of identity.\"\n\nC. No request for written informed consent of one parent shall\n\nbe required under this section if the attending physician certifies\n\nin the medical records of the pregnant unemancipated minor that a\n\nmedical emergency exists; provided, however, that the attending\n\nphysician or an agent shall, within twenty-four (24) hours after\n\ncompletion of the abortion, notify one of the parents of the minor\n\nin the manner provided in this section that an emergency abortion\n\nwas performed on the minor and of the circumstances that warranted\n\ninvocation of this subsection.\n\nD. The attending physician, or the agent of the physician,\n\nshall verbally inform the parent of the minor within twenty-four\n\n(24) hours after the performance of a medical emergency abortion or\n\nan abortion that was performed to prevent her death that an abortion\n\nwas performed on the unemancipated minor. The attending physician,\n\nor the agent of the attending physician, shall also inform the\n\nparent of the basis for the certification of the physician required\n\nunder subsection C of this section. The attending physician, or the\n\nagent of the attending physician, shall also send a written notice\n\nof the performed abortion via the United States Post Office to the\n\nlast-known address of the parent, restricted delivery, return\n\nreceipt requested. The information concerning the address of the\n\nparent shall be that which a reasonable and prudent person, under\n\nsimilar circumstances, would have relied upon as sufficient evidence\n\nthat the parent resides at that address.\n\nE.
