Stat. tit. 63, § 63-1-745.2","heading":"Definitions","body":"As used in the Pain-Capable Unborn Child Protection Act only:\n\n1. \"Abortion\" means the use or prescription of any instrument,\n\nmedicine, drug, or any other substance or device to terminate the\n\npregnancy of a woman known to be pregnant with an intention other\n\nthan to increase the probability of a live birth, to preserve the\n\nlife or health of the child after live birth, or to remove a dead\n\nunborn child who died as the result of natural causes in utero,\n\naccidental trauma, or a criminal assault on the pregnant woman or\n\nher unborn child, and which causes the premature termination of the\n\npregnancy;\n\n2. \"Attempt to perform or induce an abortion\" means an act, or\n\nan omission of a statutorily required act, that, under the\n\ncircumstances as the actor believes them to be, constitutes a\n\nsubstantial step in a course of conduct planned to culminate in the\n\nperformance or induction of an abortion in this state in violation\n\nof the Pain-Capable Unborn Child Protection Act;\n\n3. \"Postfertilization age\" means the age of the unborn child as\n\ncalculated from the fertilization of the human ovum;\n\n4. \"Fertilization\" means the fusion of a human spermatozoon\n\nwith a human ovum;\n\n5. \"Medical emergency\" means a condition that, in reasonable\n\nmedical judgment, so complicates the medical condition of the\n\npregnant woman that it necessitates the immediate abortion of her\n\npregnancy without first determining postfertilization age to avert\n\nher death or for which the delay necessary to determine\n\npostfertilization age will create serious risk of substantial and\n\nirreversible physical impairment of a major bodily function, not\n\nincluding psychological or emotional conditions. No condition shall\n\nbe deemed a medical emergency if based on a claim or diagnosis that\n\nthe woman will engage in conduct which she intends to result in her\n\ndeath or in substantial and irreversible physical impairment of a\n\nmajor bodily function;\n\n6. \"Reasonable medical judgment\" means a medical judgment that\n\nwould be made by a reasonably prudent physician, knowledgeable about\n\nthe case and the treatment possibilities with respect to the medical\n\nconditions involved;\n\n7. \"Physician\" means any person licensed to practice medicine\n\nand surgery or osteopathic medicine and surgery in this state;\n\n8. \"Probable postfertilization age of the unborn child\" means\n\nwhat, in reasonable medical judgment, will with reasonable\n\nprobability be the postfertilization age of the unborn child at the\n\ntime the abortion is planned to be performed or induced;\n\n9. \"Unborn child\" or \"fetus\" each means an individual organism\n\nof the species homo sapiens from fertilization until live birth; and\n\n10. \"Woman\" means a female human being whether or not she has\n\nreached the age of majority.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"9d97c06006f06a432ace8aca017589cd898b0b0606a49c5ec837a7e6bad461bb","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-1-745.19","next":"us-ok/okla.-stat.-tit.-63-63-1-745.3"},"notice":"GroundRules: Original legal text.
