Stat. tit. 63, § 63-1-746.1","heading":"Definitions","body":"As used in this act, the term:\n\n1. \"Abortion\" means the use or prescription of any instrument,\n\nmedicine, drug, or any other substance or device intentionally to\n\nterminate the pregnancy of a female known to be pregnant with an\n\nintention other than to increase the probability of a live birth, to\n\npreserve the life or health of the child after live birth, to remove\n\nan ectopic pregnancy or to remove a dead unborn child who died as a\n\nresult of a spontaneous abortion, accidental trauma or a criminal\n\nassault on the pregnant female or her unborn child;\n\n2. \"Attempt to perform or induce an abortion\" means an act, or\n\nan omission of a statutorily required act, that, under the\n\ncircumstances as the actor believes them to be, constitutes a\n\nsubstantial step in a course of conduct planned to culminate in the\n\nperformance of an abortion in Oklahoma in violation of this act;\n\n3. \"Fetal anomaly incompatible with life\" means a profound and\n\nirremediable congenital or chromosomal anomaly that is incompatible\n\nwith sustaining life after birth. Fetal anomaly incompatible with\n\nlife does not include conditions which can be treated;\n\n4. \"Medical emergency\" means any condition which, on the basis\n\nof the physician's good-faith clinical judgment, so complicates the\n\nmedical condition of a pregnant female as to necessitate the\n\nimmediate abortion of her pregnancy to avert her death or for which\n\na delay will create serious risk of substantial and irreversible\n\nimpairment of a major bodily function;\n\n5. \"Perinatal hospice\" means comprehensive support that\n\nincludes support from the time of diagnosis through the time of\n\nbirth and death of the infant and through the postpartum period.\n\nSupportive care may include maternal-fetal medical specialists,\n\nobstetricians, neonatologists, anesthesia specialists,\n\npsychiatrists, psychologists, or other mental health professionals,\n\nclergy, social workers, and specialty nurses; and\n\n6. \"Physician\" means a person licensed to practice medicine in\n\nthis state pursuant to Sections 495 and 633 of Title 59 of the\n\nOklahoma Statutes.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"71d1bd920847a9a30f5fb90157e1b5c30df8011f9f1ec3df4ae53e7bfda8f4a2","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-1-745.9","next":"us-ok/okla.-stat.-tit.-63-63-1-746.10"},"notice":"GroundRules: Original legal text.
