The State Board of Health shall establish policies and\n\nprocedures for conducting pre-licensure and re-licensure inspections\n\nof abortion facilities. Prior to issuing or reissuing a license,\n\nthe Department shall conduct an on-site inspection to ensure\n\ncompliance with the rules promulgated by the Board.\n\nB. The Board shall promulgate rules for conducting inspections\n\nand investigations pursuant to complaints received by the State\n\nDepartment of Health and made against any abortion facility. The\n\nDepartment shall receive, record, and dispose of complaints in\n\naccordance with established policies and procedures.\n\nC. If the State Commissioner of Health determines that there is\n\nreasonable cause to believe a licensee, licensed abortion facility\n\nor abortion facility that is required to be licensed in this state\n\nis not adhering to the requirements of Section 1-729a et seq. of\n\nTitle 63 of the Oklahoma Statutes, local fire ordinances or rules or\n\nany other law, administrative rule or regulation relating to\n\nabortion, the Commissioner and any duly designated employee or agent\n\nof the Commissioner including employees of county or city-county\n\nhealth departments and county or municipal fire inspectors,\n\nconsistent with standard medical practices, may enter on and into\n\nthe premises of the licensee, licensed abortion facility or abortion\n\nfacility that is required to be licensed in this state during\n\nregular business hours of the licensee or abortion facility to\n\ndetermine compliance with the provisions of Section 1-729a et seq.\n\nof Title 63 of the Oklahoma Statutes, local fire ordinances or\n\nrules, and any other law, administrative rule or regulation relating\n\nto abortion.\n\nD. An application for a license to operate a private office,\n\nfreestanding outpatient clinic or other facility or clinic in which\n\nabortions are performed constitutes permission for, and complete\n\nacquiescence in, an entry or inspection of the premises during the\n\npendency of the application and, if licensed, during the term of the\n\nlicense.\n\nE. If an inspection or investigation conducted pursuant to this\n\nsection reveals that an applicant, licensee or licensed abortion\n\nfacility is not adhering to the requirements of this section, the\n\nprovisions of Title 1-729a et seq. of Title 63 of the Oklahoma\n\nStatutes, local fire ordinances or rules and any other law,\n\nadministrative rule or regulation relating to abortion, the\n\nCommissioner may take action to deny, suspend, revoke or refuse to\n\nrenew a license to operate an abortion facility.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"16d181a732f753c97ea430ce0f0de37be2f9401c0d96b53d6733ab4f62a62474","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-1-749","next":"us-ok/okla.-stat.-tit.-63-63-1-750"},"notice":"GroundRules: Original legal text.
